Align your degree to the role
USCIS requires a direct relationship between your bachelor's degree field and the Commercial Lead position. A degree in business administration, marketing, or economics maps cleanly. Unrelated degrees require a detailed credential evaluation explaining the connection.
Search LCA filings for commercial roles
Pull H-1B Labor Condition Application data through OFLC Wage Search using SOC codes tied to sales and commercial management. This shows which employers have actually filed for these roles, not just posted them.
Target companies with cap-exempt status
Universities, nonprofit research institutions, and government-affiliated entities are cap-exempt. A Commercial Lead role at a qualifying employer bypasses the annual H-1B lottery entirely, removing the biggest obstacle most applicants face.
Use Migrate Mate to find verified sponsors
Filter Commercial Lead openings by verified H-1B filing history on Migrate Mate. This surfaces employers whose DOL Labor Condition Application records confirm they've sponsored this role before, cutting out guesswork in your outreach.
Negotiate offer timing around the April filing window
H-1B cap registrations open in March for an October 1 start date. If you receive an offer in June, your employer can't file until the following March. Factor this 10 to 16 month gap into offer negotiations and start-date conversations.
Prepare a prevailing wage defense before your offer
Your employer's LCA must certify your salary meets the DOL prevailing wage for your SOC code and location. Check your wage level against OFLC Wage Search data before accepting an offer so you can flag any gap early.
H-1B Visa Commercial Lead: Frequently Asked Questions
Does a Commercial Lead role qualify as a specialty occupation for H-1B purposes?
Yes, if the position normally requires at least a bachelor's degree in a specific field like business, marketing, or economics. The key is that the degree requirement must be tied to the job duties, not just listed as a preference. Roles that accept any bachelor's degree regardless of field are harder to qualify. Your offer letter and job description should reflect degree specificity.
Which industries sponsor H-1B visas most often for Commercial Lead positions?
Technology companies, enterprise software vendors, management consulting firms, and financial services firms file the highest volume of H-1B LCAs for commercial and sales leadership roles. These employers have established HR processes for sponsorship and typically have in-house immigration counsel. You can find verified sponsors with active LCA filing history for this role on Migrate Mate.
Can my employer file an H-1B for a Commercial Lead role while I'm on OPT?
Yes. If you're on post-completion OPT, your employer can submit your H-1B registration in March for an October 1 start date. If your OPT expires before October 1 and you're selected, the cap-gap provision automatically extends your work authorization. STEM OPT holders have a longer buffer, but you still need to confirm your OPT end date against the filing timeline.
What SOC code does DOL typically use for Commercial Lead roles?
Commercial Lead positions most often fall under SOC 11-2022 (Sales Managers) or SOC 41-1012 (First-Line Supervisors of Non-Retail Sales Workers), depending on the scope of the role. The SOC code your employer selects determines the prevailing wage level USCIS and DOL apply to your LCA. Cross-reference the O*NET occupation profile to confirm the best fit before your employer files.
How does changing employers affect my H-1B if I'm a Commercial Lead?
H-1B portability under AC21 lets you change employers after your petition has been pending for 180 days, as long as the new role is in the same or a substantially similar occupational classification. For Commercial Lead roles, the new employer must file an H-1B transfer petition before you start. USCIS does not require you to stop working during the transfer period, provided the petition is filed timely.
