Verify your degree meets specialty occupation
USCIS requires Construction Superintendent petitions to show the role demands at least a bachelor's degree in a directly related field. A degree in construction management, civil engineering, or architecture positions you strongest. General business degrees often draw Requests for Evidence.
Target contractors with LCA filing histories
Search DOL's OFLC Wage Search by occupation code 11-9021 to identify general contractors and construction managers who have certified Labor Condition Applications for superintendent roles. Employers with multiple prior filings signal an established H-1B sponsorship process.
Use Migrate Mate to filter verified sponsors
Search Construction Superintendent roles on Migrate Mate to surface employers with confirmed H-1B LCA filing history for this occupation code. That filters out postings from companies that list sponsorship as possible but have no DOL filing record to back it up.
Document field experience with credentials
OSHA 30-Hour certification, LEED accreditation, or state contractor licensing can reinforce the specialty occupation argument in your I-129 petition. Assemble these credentials before the offer stage so your employer's attorney can reference them immediately.
Negotiate H-1B filing costs before signing
Employers are prohibited from deducting the I-129 filing fee from your wages, but attorney fees and premium processing are negotiable. Confirm in writing which costs the employer covers before you accept an offer, since practices vary widely across construction firms.
Plan around the cap registration window
H-1B cap registration runs in March each year through USCIS. Construction Superintendent roles at for-profit general contractors are cap-subject, so your employer must register you during that window for an October 1 start date. Missing it means waiting a full year.
H-1B Visa Construction Superintendent: Frequently Asked Questions
Does a Construction Superintendent role qualify as a specialty occupation for H-1B purposes?
It can, but the employer must demonstrate the specific position requires at least a bachelor's degree in a directly related field such as construction management or civil engineering. Generic superintendent roles that accept any degree field often receive Requests for Evidence from USCIS. The job description and company hiring norms both factor into the adjudication.
Which employers sponsor H-1B visas for Construction Superintendent positions?
Large general contractors, national construction management firms, and major specialty subcontractors are the most consistent sponsors because they have in-house or retained immigration counsel. You can identify them by searching DOL LCA disclosure data by occupation code 11-9021. Migrate Mate surfaces these employers directly so you can focus applications on verified sponsors.
How does the prevailing wage requirement affect Construction Superintendent hiring?
Before filing an H-1B, the employer must certify with DOL that your offered wage meets or exceeds the prevailing wage for the role in that geographic area. For Construction Superintendents, prevailing wages vary significantly by region and project type. You can look up applicable wage levels using the OFLC Wage Search before accepting an offer.
Can I transfer my H-1B to a new construction employer mid-project?
Yes. H-1B portability under AC21 lets you start working for a new sponsor as soon as the transfer petition is filed, not after approval. For Construction Superintendents moving between projects or contractors, the new employer files an H-1B transfer petition and you can begin the new role immediately, provided your current status is valid.
Does project-based work affect my H-1B status as a Construction Superintendent?
Yes, and this is a common complication. H-1B status is tied to a specific employer and worksite. If you move between job sites or your employer's project mix changes significantly, the LCA may need to cover additional locations. Your employer's attorney should file amended or new LCAs for material worksite changes to keep your status compliant.
