Verify your role qualifies as specialty occupation
Pull the O*NET profile for data migration or database administration roles and confirm the listed education requirement is a specific bachelor's degree field. USCIS denies H-1B petitions when job duties appear generalist or when any degree is listed as acceptable.
Check prevailing wages before negotiating your offer
Use the OFLC Wage Search to look up Level I through Level IV wages for your job title and work location. Your employer's LCA must certify at least the prevailing wage, so knowing the floor prevents an offer that USCIS will later flag.
Target employers with cap-exempt filing history
Universities, nonprofit research institutions, and government-affiliated entities can file H-1B petitions outside the annual lottery cap. Data migration work at healthcare systems or university IT departments often qualifies, letting you start without waiting for an October 1 start date.
Use Migrate Mate to filter for verified H-1B sponsors
Search Data Migration Consultant roles on Migrate Mate to see which employers have active LCA filing history for this job title. That narrows your list to companies already familiar with the H-1B process for this specific occupation.
Request a specialty occupation letter from your employer
Ask the hiring manager to document why the role requires a degree in a specific field, not just any bachelor's degree. USCIS increasingly issues Requests for Evidence on data migration roles where the job description lists broad technical skills without a clear degree requirement.
Clarify project-based work arrangements before filing
Data migration consultants often work at third-party client sites. USCIS requires itinerary documentation and valid end-client contracts when the work location differs from the petitioning employer's address. Confirm your employer can provide these before the I-129 is submitted.
H-1B Visa Data Migration Consultant: Frequently Asked Questions
Does a Data Migration Consultant role qualify as an H-1B specialty occupation?
Yes, provided the job description requires a bachelor's degree or higher in a specific field such as computer science, information systems, or data engineering. The key risk for this title is when employers list broad requirements like 'any technical degree,' which gives USCIS grounds to deny the petition. A well-drafted job description tied to a specific degree field is essential.
How do I find employers who sponsor H-1B visas for Data Migration Consultant roles?
Migrate Mate shows verified LCA filing history by employer and job title, so you can see which companies have filed for Data Migration Consultant roles specifically rather than relying on general sponsorship claims. Cross-referencing this with DOL disclosure data lets you confirm the employer's experience with this occupation before you apply.
Can I work at a client site on an H-1B as a Data Migration Consultant?
Yes, but your employer must document the placement with a valid end-client contract and provide USCIS with a worksite itinerary if multiple locations are involved. Third-party placement arrangements receive additional scrutiny because USCIS wants to confirm the petitioning employer controls your day-to-day work, not the end client.
What happens to my H-1B status if my data migration project ends early?
You have a 60-day grace period from your last day of employment to find a new H-1B sponsor, change to another visa status, or depart the U.S. Project-based roles in consulting carry this risk more often than permanent staff positions. Starting your job search before a project closes is the most practical way to avoid a gap in status.
Does my employer need to file a new H-1B petition if I move to a different project?
Not always. A change in project or client site that stays within the same occupational classification and geographic area typically doesn't require a new I-129, but your employer must amend the petition if your work location changes to a new metropolitan statistical area. USCIS requires a new LCA certified at the prevailing wage for the new location before the amendment is filed.
