Benchmark your prevailing wage before negotiating
Look up the SOC code for Data Science Directors using the OFLC Wage Search before your offer stage. Your employer's LCA must certify a wage at or above the prevailing wage for your location and experience level.
Target cap-exempt employers strategically
Universities, nonprofit research organizations, and government entities are exempt from the H-1B lottery. Data Science Director roles at these institutions can be filed any time of year, bypassing the April registration window entirely.
Document your specialty occupation case thoroughly
Director-level data science roles sometimes draw RFEs questioning whether a specific degree field is required. Collect job postings, internal org charts, and your employer's written justification linking your degree field directly to the role's core responsibilities.
Search Migrate Mate to identify active H-1B sponsors
Filter by Data Science Director roles on Migrate Mate to see which employers have LCA filing history for this title. This lets you prioritize companies with a demonstrated track record of sponsoring H-1B petitions for senior data leadership positions.
Confirm your employer's E-Verify enrollment before accepting
H-1B sponsors must be enrolled in E-Verify. Ask HR to confirm enrollment status before you resign from your current role. A sponsor who isn't enrolled cannot legally file your H-1B petition, and onboarding delays can affect your status.
Plan your I-129 filing timeline around the lottery
USCIS opens H-1B registration in March for an October 1 start date. If you're selected, your employer has until June to file the full I-129 petition. Confirm your employer's internal legal timeline well before the registration window opens.
H-1B Visa Data Science Director: Frequently Asked Questions
Does a Data Science Director role qualify as an H-1B specialty occupation?
Yes. A Data Science Director role qualifies because it typically requires at least a bachelor's degree in statistics, computer science, mathematics, or a related field as a normal requirement for entry. USCIS evaluates specialty occupation based on the actual duties and the degree requirement, not just the job title. Director-level roles with strategic and technical responsibilities generally satisfy this standard, though your employer may need to document why a specific degree field is required.
Which employers sponsor H-1B visas for Data Science Director positions?
Large technology companies, financial services firms, healthcare systems, and enterprise software companies regularly sponsor H-1B visas for senior data science leadership roles. Cap-exempt employers like research universities and nonprofits affiliated with higher education also hire at the director level. Migrate Mate surfaces employers with verified LCA filing history for Data Science Director titles, so you can identify active sponsors without manual DOL database searches.
Can I transfer my H-1B to a new employer for a Data Science Director role?
Yes. Under H-1B portability, you can start working for a new employer as soon as they file a transfer petition with USCIS, without waiting for approval, as long as you've been in valid H-1B status and the petition is non-frivolous. Your new employer files a new I-129 and LCA specific to the Director role and your work location. You don't re-enter the lottery if you already hold H-1B status.
What is the prevailing wage requirement for a Data Science Director on H-1B?
Your employer's LCA must certify a wage at or above the prevailing wage for the Data Science Director SOC code in your specific metropolitan area. The DOL sets four wage levels; most Director roles are classified at Level III or IV. You can verify the applicable wage using the OFLC Wage Search before your offer stage to confirm whether a proposed salary meets the DOL threshold for your location.
Does a Data Science Director need a master's degree for H-1B approval?
A master's degree isn't required by law, but it can strengthen the specialty occupation case, particularly if your employer's other hires at this level hold advanced degrees. USCIS looks at the employer's own degree requirements, industry norms, and whether the role requires theoretical and practical application of highly specialized knowledge. The O*NET profile for this occupation and comparable job postings are commonly used as supporting evidence in the petition.
