Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Embedded
Map your degree to embedded SOC codes
USCIS evaluates specialty occupation by matching your degree field to the role's Standard Occupational Classification code. Pull your target job's SOC code from O*NET and confirm your degree aligns before applying. Mismatches trigger RFEs.
Target defense contractors with active LCA filings
Defense and aerospace firms like Raytheon, Northrop Grumman, and L3Harris file LCAs regularly for embedded roles. Run an OFLC Wage Search filtered by SOC code 17-2061 to identify which employers have certified wages for embedded systems positions recently.
Use Migrate Mate to filter H-1B sponsors
Search Migrate Mate to find embedded roles at employers with verified H-1B filing history. Filtering by DOL Labor Condition Application data shows you which companies have sponsored this role before, saving time on employers unlikely to file.
Get your ITAR clearance eligibility documented early
Many embedded roles at defense contractors require ITAR compliance, which limits access to U.S. persons. Confirm your visa status satisfies the employer's export control requirements before the offer stage. Some roles are restricted to U.S. citizens or permanent residents regardless of H-1B eligibility.
Negotiate premium processing into your offer
H-1B standard processing can run six months or more. Ask your employer to include USCIS premium processing in your offer letter. This reduces adjudication to 15 business days and protects your start date when a project timeline is fixed.
Document proprietary toolchain experience for the petition
Your employer's H-1B petition must show the role requires a specific degree. Work with their immigration counsel to document how your RTOS, JTAG debugger, or hardware description language experience ties directly to the degree requirement. Vague job descriptions invite RFEs.
H-1B Visa Embedded: Frequently Asked Questions
Do embedded engineering roles qualify as a specialty occupation for H-1B purposes?
Yes. USCIS recognizes embedded systems engineering as a specialty occupation when the role requires at least a bachelor's degree in electrical engineering, computer engineering, computer science, or a directly related field. Roles involving firmware development, real-time operating systems, or hardware-software co-design consistently meet this standard, provided the employer's job description ties specific degree requirements to the actual duties.
Which industries sponsor H-1B visas most often for embedded roles?
Defense and aerospace contractors, automotive OEMs developing ADAS or EV systems, semiconductor manufacturers, and IoT hardware companies are the most consistent H-1B sponsors for embedded engineers. Medical device firms are also active sponsors because FDA-regulated embedded software development requires specialized credentials. You can identify active sponsors by filtering for embedded SOC codes in DOL LCA disclosure data, or by browsing verified sponsors on Migrate Mate.
Can I transfer my H-1B to a new embedded engineering job without losing my status?
Yes. H-1B portability under AC21 lets you start working for a new employer as soon as the new H-1B transfer petition is filed, as long as your prior petition has been approved and you've been in valid H-1B status. Your new employer must file before your current status expires. The embedded role at the new employer must still qualify as a specialty occupation under the same degree-to-duties alignment standard.
How does ITAR affect H-1B sponsorship for embedded engineers at defense companies?
International Traffic in Arms Regulations classify certain embedded systems work, particularly on defense electronics, weapons guidance, or satellite hardware, as controlled technology. Employers must assess whether a foreign national's access constitutes a deemed export requiring a license. Many defense contractors limit these roles to U.S. persons, meaning H-1B holders may be ineligible regardless of sponsorship willingness. Always confirm export control status before pursuing an offer.
What does prevailing wage mean for an embedded engineering H-1B petition?
Prevailing wage is the minimum salary your employer must certify on the Labor Condition Application filed with DOL before petitioning USCIS. For embedded engineers, prevailing wage is set by SOC code, geographic location, and experience level, with four wage tiers ranging from entry-level to fully competent. Your employer uses the OFLC Wage Search to determine the applicable rate and must pay at or above it for the duration of your H-1B status.
