Verify your degree aligns with the role
USCIS requires a direct relationship between your degree field and the Food Supervisor position. A degree in food science, nutrition, culinary management, or hospitality management strengthens your specialty occupation argument. A general business degree alone often triggers a Request for Evidence.
Use OFLC Wage Search before negotiating salary
Look up the prevailing wage for Food Supervisor roles in your target metro area using the OFLC Wage Search tool. Your employer must pay at least the DOL wage level for that location and occupation code, so knowing the floor before your offer protects your petition.
Target employers already filing H-1B petitions
Search Migrate Mate to identify Food Supervisor employers with verified H-1B LCA filing history. Companies that have filed for this occupation code before understand the process and are far less likely to withdraw sponsorship mid-petition over cost or compliance concerns.
Check whether the employer is E-Verify enrolled
H-1B employers must be enrolled in E-Verify before USCIS will approve your petition. Confirm enrollment status with HR during the offer stage, not after signing. Food manufacturing facilities with federal contracts are typically enrolled, but smaller restaurant groups often are not.
Document supervisory scope to meet specialty occupation
Food Supervisor roles that involve scheduling and routine floor oversight can struggle to meet specialty occupation requirements. Ask your employer to detail in the support letter how the role requires theoretical and practical application of food science, HACCP compliance, or operations management at a degree level.
File for premium processing if your start date is fixed
If your employer has a specific operational start date, request premium processing through USCIS at filing. Standard H-1B processing can stretch beyond six months, and food production roles often have seasonal or contract-driven timelines that can't absorb that delay.

Find Food Supervisor JobsFood Supervisor H-1B Visa: Frequently Asked Questions
Does a Food Supervisor role qualify as a specialty occupation for H-1B purposes?
It depends on how the role is defined. USCIS evaluates whether the position normally requires at least a bachelor's degree in a specific field. A Food Supervisor overseeing HACCP compliance, food safety audits, or production quality control tied to a food science or culinary management degree has a stronger case than a general floor supervisor role. The employer's support letter and job description carry significant weight in this determination.
Which industries sponsor H-1B visas for Food Supervisor positions?
Food manufacturing companies, large hospitality groups, contract food service operators, and institutional dining providers in healthcare and higher education are the most consistent H-1B sponsors for Food Supervisor roles. Employers in these sectors often have established immigration compliance teams. Use Migrate Mate to browse Food Supervisor openings filtered by employers with confirmed H-1B LCA filing history in this occupation.
Can my employer file an H-1B petition for a Food Supervisor role without a PERM labor certification?
Yes. H-1B petitions do not require PERM labor certification. PERM is part of the employment-based green card process, not the H-1B nonimmigrant classification. Your employer files a Labor Condition Application with the DOL and then submits the I-129 petition to USCIS. The entire H-1B process is separate from and faster than the PERM pathway.
What happens to my H-1B status if my Food Supervisor employer terminates me?
You enter a 60-day grace period after termination, during which you can transfer your H-1B to a new employer, change to another visa status, or depart the U.S. Your new employer must file an H-1B transfer petition before the grace period expires. USCIS allows you to begin working for the new employer once the transfer is filed, not just approved, under portability rules.
Does the O*NET classification for Food Supervisor support an H-1B specialty occupation argument?
O*NET classifies Food Service Managers in Job Zone 3, which indicates moderate preparation and does not automatically imply a bachelor's degree requirement. This can create friction with USCIS's specialty occupation standard. To address this, your employer's support letter should document why your specific position, given its scope and technical requirements, goes beyond the O*NET baseline and genuinely requires a degree in food science, nutrition, or a related field.
