Verify your fellowship credentials meet specialty occupation
USCIS requires your degree and fellowship to directly correspond to the Foot and Ankle Surgeon role. An orthopedic surgery fellowship alone may prompt an RFE if the job description doesn't explicitly tie foot and ankle subspecialty to your training.
Target hospital systems with cap-exempt status
Academic medical centers and nonprofit research hospitals are often cap-exempt H-1B employers, letting you start immediately without waiting for the October 1 lottery cycle. Confirm cap-exempt status before accepting an offer.
Search LCA filing history on Migrate Mate
Filter by Foot and Ankle Surgeon or orthopedic surgery job codes to see which employers have active DOL Labor Condition Application filings for this role, giving you a verified list of actual sponsors rather than guessing from job postings.
Request the employer confirm prevailing wage tier early
Use the OFLC Wage Search to look up the prevailing wage for your SOC code and intended work location before negotiating. Employers must certify your offered wage meets at least the Level I DOL threshold, and surgical subspecialties often fall at Level III or IV.
Prepare state medical licensure before the I-129 filing
Many states require a full medical license before H-1B approval, not just a training license. Delays in state board processing can hold up your USCIS petition, so initiate the licensure application as soon as you have a signed offer letter.
Clarify moonlighting and on-call arrangements with your attorney
Foot and Ankle Surgeons frequently cover multiple hospital locations or outpatient surgery centers. Each site may require a separate LCA filing with DOL, and working at an unlisted location is an H-1B compliance violation your employer must proactively manage.

Find Foot and Ankle Surgeon JobsFoot and Ankle Surgeon H-1B Visa: Frequently Asked Questions
Does a Foot and Ankle Surgeon role qualify as an H-1B specialty occupation?
Yes. USCIS classifies Foot and Ankle Surgeon positions as specialty occupations because they require an MD, DO, or DPM at minimum, plus completed residency and fellowship training in a directly related surgical subspecialty. The O*NET profile for this role confirms the minimum education requirement is a doctoral degree, satisfying the specialty occupation standard without dispute.
Which types of employers sponsor H-1B visas for Foot and Ankle Surgeons?
Hospital systems, academic medical centers, VA facilities, and large orthopedic or podiatric surgery group practices are the most active sponsors. Academic medical centers and nonprofit hospitals often hold cap-exempt status, which means you can start any time of year without entering the H-1B lottery. You can browse verified sponsoring employers on Migrate Mate using LCA filing data.
How does the H-1B lottery affect hiring timelines for Foot and Ankle Surgeons?
If your employer is cap-subject, your petition enters the USCIS lottery in March for an October 1 start date, meaning a six-month minimum gap between offer and employment. Cap-exempt employers, such as nonprofit teaching hospitals, bypass this entirely. Confirm your prospective employer's cap-exempt status upfront so you can plan accordingly.
What documentation does an employer need to sponsor a Foot and Ankle Surgeon on H-1B?
The employer must file a certified Labor Condition Application with DOL before submitting Form I-129 to USCIS. Supporting documentation typically includes your medical school diploma, residency completion certificate, fellowship certificate, board certification or exam results, and a current state medical license. The employer's attorney structures these into a specialty occupation support letter tying your credentials to the specific role.
Can a Foot and Ankle Surgeon work at multiple surgery centers under one H-1B petition?
Not automatically. Each worksite where you regularly practice must be listed on the DOL Labor Condition Application. If you rotate between a hospital and an outpatient surgery center, the employer must file LCAs covering all locations. Adding a new worksite mid-status requires an amended H-1B petition to remain compliant with USCIS regulations.
