Verify your PMHNP credentials meet H-1B standards
USCIS requires a direct relationship between your degree and the role. A psychiatric-mental health NP certificate or MSN with a PMHNP concentration satisfies specialty occupation. A general nursing degree without the psychiatric specialization often triggers an RFE, so gather transcripts that name the specialty explicitly.
Check prevailing wage tiers before negotiating salary
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your SOC code and work location. Use the OFLC Wage Search to look up your specific metro area before accepting an offer, so you can spot whether a proposed salary clears the threshold.
Target employers with behavioral health service lines
Health systems that operate inpatient psychiatric units, integrated behavioral health programs, or federally qualified health centers file H-1B petitions far more consistently than outpatient-only practices. Prioritize employers whose clinical infrastructure justifies a full-time PMHNP headcount rather than per-diem or contract arrangements.
Search H-1B filing history on Migrate Mate
Filter Migrate Mate by the Psychiatric Nurse Practitioner job category to see which employers have active H-1B LCA filings for this role. DOL Labor Condition Application data shows you exactly which organizations have sponsored PMHNPs, so you're not guessing about sponsorship willingness before you apply.
Confirm your state license is transferable before relocating
H-1B approval for a PMHNP is tied to a specific work location. If your offer is in a non-compact state and your current license is from a different state, you'll need to complete that state's full licensure process before your employer can file the I-129. Start the application before your start date, not after.
Request premium processing if your start date is fixed
USCIS standard processing for an I-129 can run several months. If your employer is filling a critical psychiatric staffing gap with a hard start date, ask HR to authorize premium processing, which gets an adjudication decision within 15 business days. The employer pays this fee under H-1B rules.
H-1B Visa Psychiatric Nurse Practitioner: Frequently Asked Questions
Does a Psychiatric Nurse Practitioner role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS classifies PMHNP roles as specialty occupations because the position requires at minimum a master's degree in psychiatric-mental health nursing or an equivalent graduate credential. General RN roles do not meet this bar, but the advanced practice designation with a psychiatric specialization does. Your employer will document this in the H-1B petition using your degree transcripts and the job description.
Which types of employers sponsor H-1B visas for Psychiatric Nurse Practitioners?
Health systems with dedicated behavioral health service lines, community mental health centers, federally qualified health centers, and telehealth platforms with psychiatric service lines are the most consistent H-1B sponsors for PMHNPs. Private outpatient practices occasionally sponsor but are less common because the petition cost and compliance burden are harder to absorb at smaller scale. Use Migrate Mate to identify employers with documented H-1B LCA filings for this role.
How does the H-1B cap and lottery affect Psychiatric Nurse Practitioners?
Most PMHNP roles at nonprofit hospitals, federally qualified health centers, and government health agencies are cap-exempt, meaning they can file H-1B petitions year-round without entering the annual lottery. For-profit employers are cap-subject and must register during the March lottery window. If you're targeting for-profit health systems, timing your job search to align with the registration period in February and March matters.
What does the H-1B prevailing wage requirement mean for PMHNP job offers?
Before your employer files the Labor Condition Application with DOL, they must certify that your offered wage meets or exceeds the prevailing wage for your SOC code in your specific work location. PMHNPs fall under a specialized nursing or advanced practice SOC code, and wages vary significantly by metro area. You can verify the applicable wage level using the OFLC Wage Search before finalizing your offer.
Can a Psychiatric Nurse Practitioner change employers while on H-1B status?
Yes, through H-1B portability. Once USCIS has received your new employer's I-129 petition, you can start working for them before it's approved, as long as your previous H-1B was approved and you haven't been out of status. The new employer must file their own LCA and I-129 specific to the PMHNP role and your work location. O*NET occupation codes and your state licensure documents will anchor the specialty occupation case.
