Verify your licensure transfers across states
State psychology licensure requirements vary, and your H-1B petition must reflect the state where you'll actually practice. Confirm reciprocity or endorsement rules before your employer files, since a mismatch between your license and work location can trigger an RFE.
Target cap-exempt employers first
Hospitals affiliated with universities, federal agencies like the Bureau of Prisons, and nonprofit research institutions can file H-1B petitions year-round without the lottery. Forensic Psychologist openings at these employers don't depend on the April registration window.
Check the OFLC Wage Search before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your SOC code and work location. Pull the OFLC Wage Search figures yourself before salary discussions so you know the floor your employer is legally required to meet.
Build your specialty occupation documentation early
USCIS scrutinizes Forensic Psychologist petitions closely because the role spans law, psychology, and clinical practice. Gather your doctoral transcripts, internship records, and any court-recognized expert witness credentials before your employer starts the I-129 filing.
Use Migrate Mate to find employers with H-1B filing history
Search Migrate Mate to filter Forensic Psychologist roles by employers who have filed H-1B petitions in your specialty. That filing history confirms the employer understands the sponsorship process, reducing delays at the offer stage.
Clarify supervision requirements with your employer
Some forensic psychology roles require postdoctoral supervised hours for full licensure. If you're still accumulating hours, confirm your employer can structure the H-1B position around a supervised role, since the petition must reflect your actual duties and qualifications at time of filing.

Find Forensic Psychologist JobsForensic Psychologist H-1B Visa: Frequently Asked Questions
Does a Forensic Psychologist role qualify as an H-1B specialty occupation?
Yes. Forensic Psychologist positions typically require a doctoral degree in psychology, which satisfies USCIS's specialty occupation standard. The key is that your employer's job description must explicitly require a doctorate in a directly related field, not just prefer one. If the posting accepts any bachelor's degree, USCIS may challenge the specialty occupation classification.
Which types of employers sponsor H-1B visas for Forensic Psychologists?
Federal agencies, state forensic hospitals, correctional systems, university-affiliated medical centers, and nonprofit behavioral health organizations are the most consistent H-1B sponsors for this role. Many of these employers hold cap-exempt status, meaning they can file outside the annual lottery window. You can filter by employers with verified H-1B filing history on Migrate Mate.
How does state psychology licensure affect my H-1B petition?
Your H-1B petition is tied to a specific worksite state, and USCIS expects you to hold or be eligible for licensure in that state. If you're licensed in a different state, your employer's attorney needs to address the licensing pathway in the petition. Some states require additional supervised hours or exams that can affect your start date.
Can I work at multiple court or agency locations on one H-1B petition?
Forensic Psychologists often consult across facilities, courthouses, or detention centers. Each worksite may require a separate Labor Condition Application if it's in a different metropolitan statistical area. Your employer must file the appropriate LCA amendments before you begin work at any new location, and USCIS can audit compliance through worksite inspections.
What happens to my H-1B status if I switch from a private practice to a government agency?
Changing employers requires a new H-1B petition filed by the new employer before you start work, unless your new employer is a federal agency exempt from standard H-1B cap rules. You can begin working for the new employer as soon as USCIS receives the transfer petition, under portability rules, provided you've maintained valid status.
