Verify your degree field aligns precisely
USCIS scrutinizes Head of Product petitions when your degree is in a broad field like business administration. Document how your coursework directly supports product strategy, roadmap planning, and cross-functional leadership to strengthen the specialty occupation case.
Check employer LCA history on Migrate Mate
Search Head of Product LCA filings by employer on Migrate Mate before applying. You'll see which companies have sponsored this exact role before, reducing the risk of landing an offer from an employer unfamiliar with the H-1B process.
Benchmark your offered wage against OFLC data
Before accepting an offer, run the job title through the OFLC Wage Search to confirm your offered salary meets the prevailing wage for your metro area. An underpaying offer triggers an LCA violation and delays or kills the petition.
Target cap-exempt institutions for faster timelines
Universities, nonprofits affiliated with higher education, and qualifying research organizations are cap-exempt. Head of Product roles at edtech platforms or university spinouts sometimes qualify, letting you start immediately without waiting for the October 1 cap-subject start date.
Negotiate petition filing before your OPT expires
If you're on OPT, confirm your employer will file the I-129 in the March registration window before your EAD end date. If your OPT expires before October 1, cap-gap protection only applies if the petition is timely filed and selected.
Use O*NET to document specialty occupation evidence
Pull the O*NET occupation profile for product management roles and include the listed education and knowledge requirements in your petition support letter. This third-party DOL-backed data directly counters RFEs questioning whether the role requires a specific degree.
H-1B Visa Head Of Product: Frequently Asked Questions
Does a Head of Product role qualify as a specialty occupation for H-1B purposes?
Yes, but the petition needs to show the role requires a bachelor's degree in a specific field, not just any degree. Product management sits in a gray zone because employers sometimes list broad requirements. Your offer letter and job description should specify that a degree in computer science, engineering, or a related technical field is required for the role.
Which employers consistently sponsor H-1B visas for Head of Product roles?
Enterprise software companies, fintech firms, and large consumer tech platforms file the most LCAs for senior product leadership roles. Mid-size SaaS companies with established HR and legal infrastructure are also reliable sponsors. You can browse verified H-1B filing history by employer and job title on Migrate Mate to identify companies that have sponsored this specific role before.
What happens to my H-1B status if I'm laid off as a Head of Product?
You have a 60-day grace period from your last day of employment to find a new sponsor, change status, or depart the U.S. During that window, you can't work. A new employer must file an H-1B transfer petition before the grace period ends to maintain lawful status. If you're selected in a new lottery rather than transferring, you'll need to wait for the October 1 start date.
Can I transfer my H-1B to a startup that hasn't sponsored visas before?
Yes. Any U.S. employer with an EIN can file an H-1B petition, including early-stage startups. The risk is that USCIS may scrutinize the employer's financial stability and the bona fide nature of the role more closely. Startups without prior LCA filings should prepare strong documentation, including funding records, organizational charts, and a detailed job description.
Does my H-1B get counted against the cap if I move from one company to another?
No. If you're already in valid H-1B status, a transfer to a new employer is cap-exempt. The new employer files a portability petition under AC21, and you can start working once the receipt notice is issued, without waiting for approval. Only initial petitions for workers not already holding H-1B status are subject to the annual cap and lottery.
