Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Head Of Technology
Map your credentials to specialty occupation standards
USCIS requires that a Head of Technology role normally requires a specific bachelor's degree, not just any degree. Document how your technical degree directly relates to the strategic and architectural responsibilities in your job description before any employer files.
Target employers with cap-exempt filing options
Universities, affiliated nonprofits, and government research organizations can file H-1B petitions outside the annual lottery cap. Head of Technology roles at these institutions can start immediately after approval, bypassing the October 1 wait entirely.
Search H-1B filing history on Migrate Mate
Filter Head of Technology roles by employers with verified H-1B LCA filing history on Migrate Mate. This shows which companies have actively sponsored technical leadership positions, so you're not guessing about sponsorship willingness during interviews.
Verify prevailing wage tier before accepting an offer
Head of Technology roles typically fall at DOL wage Level III or IV. Use the OFLC Wage Search to confirm the prevailing wage for your job's SOC code and work location before signing, since the LCA must certify your offered salary meets that threshold.
Negotiate offer timing around the H-1B lottery window
H-1B registrations open in March, and USCIS selects in April for an October 1 start. If you're on F-1 OPT, confirm your EAD expiration date covers the gap. Employers filing for senior technology roles often use premium processing to reduce the 3-to-5-month petition wait.
Clarify the LCA job duties before USCIS adjudication
Requests for Evidence on Head of Technology petitions often challenge whether the role genuinely requires a specific degree versus broad business management experience. Work with your employer to ensure the LCA job description emphasizes technical architecture, engineering oversight, or systems design responsibilities.
H-1B Visa Head Of Technology: Frequently Asked Questions
Does a Head of Technology role qualify as an H-1B specialty occupation?
Yes, if the position requires at least a bachelor's degree in a specific technical field such as computer science, information technology, or software engineering. USCIS scrutinizes executive and hybrid leadership titles more closely than purely technical roles, so the job description must emphasize specialized technical duties, not just team management or business strategy, to satisfy the specialty occupation standard.
Which employers sponsor H-1B visas for Head of Technology positions?
Technology companies, financial services firms, healthcare systems, and large enterprises with in-house engineering teams regularly sponsor H-1B visas for Head of Technology roles. You can browse employers with verified H-1B LCA filing history for technical leadership positions on Migrate Mate, filtering by industry or location to identify companies that have sponsored comparable roles before.
Can a Head of Technology petition be filed outside the H-1B lottery cap?
Yes, if the employer is a qualifying cap-exempt institution. Universities, nonprofit research organizations affiliated with universities, and government research entities can file H-1B petitions year-round without competing in the annual lottery. Head of Technology roles at university IT departments or affiliated research centers are common examples where cap-exempt filing applies.
What happens to my H-1B status if I'm promoted from a technical role to Head of Technology?
A material change in job duties, title, or location generally requires an amended H-1B petition before the change takes effect. Moving into a Head of Technology role with substantially different responsibilities triggers this requirement. Your employer needs to file a new LCA certified by DOL reflecting the updated position before USCIS processes the amended petition.
How do I know if the H-1B prevailing wage for Head of Technology matches my offer?
Use the OFLC Wage Search to look up the prevailing wage for your specific SOC code, which is typically in the computer and information systems managers category, filtered by your work location. The DOL-certified LCA your employer files must certify your offered salary meets at least the Level I prevailing wage, and senior roles often require Level III or IV compliance.
