Verify your HRBP role qualifies
Pull the O*NET profile for HR Business Partner and confirm your job duties map to a specialty occupation requiring a specific degree field. Generalist titles with broad, non-degree-specific duties can draw USCIS scrutiny, so get your job description aligned before applying.
Target employers with active LCA filings
Use Migrate Mate to filter HRBP openings by employers with verified H-1B LCA filing history. This skips companies that list HR roles but lack the infrastructure or intent to navigate H-1B sponsorship for non-technical positions.
Check prevailing wage levels before negotiating
Run your target city and HRBP job code through the OFLC Wage Search before your offer conversation. Your employer's LCA must certify at least the prevailing wage for your SOC code and location, and knowing Level I through IV ranges helps you negotiate from an informed position.
Prepare a degree-to-role nexus document
USCIS frequently issues RFEs for HRBP petitions questioning whether an HR or business degree is required, not merely preferred. Draft a written explanation connecting your specific duties to your degree field before your employer files, so the attorney can incorporate it from day one.
Prioritize cap-exempt employers in your search
Universities, nonprofit research institutions, and government-affiliated entities are cap-exempt, meaning they can file your H-1B petition outside the annual lottery. HRBP roles exist at these organizations and offer a direct path to H-1B status without waiting for April registration.
Confirm E-Verify enrollment before signing an offer
Your employer must be enrolled in E-Verify to hire you on H-1B status. Ask HR directly or check the employer's public E-Verify participation before you reach the offer stage, not after, to avoid delays in your start date.

Find HR Business Partner JobsHR Business Partner H-1B Visa: Frequently Asked Questions
Does an HR Business Partner role qualify as a specialty occupation for H-1B purposes?
It can, but it's not automatic. USCIS requires that the position normally requires at least a bachelor's degree in a specific field like human resources, organizational psychology, or business administration. Generic HRBP postings that list a degree as preferred rather than required, or that accept any bachelor's degree, are more likely to receive an RFE. The job description wording matters significantly.
Which types of employers sponsor H-1B visas for HR Business Partner roles?
Large multinationals, Fortune 500 companies, and technology firms with dedicated people operations teams file the most LCAs for HRBP titles. Cap-exempt organizations like universities and nonprofit hospitals also hire HRBPs and can file outside the lottery. You can browse verified sponsoring employers with active HRBP openings on Migrate Mate, filtered by H-1B filing history.
Can I transfer my H-1B to a new employer if I switch HRBP roles?
Yes. Under H-1B portability, you can start working for a new employer once they file a transfer petition, without waiting for approval, as long as your current H-1B is valid and you haven't had a gap in authorized status. The new employer must file a fresh I-129 and LCA for the specific HRBP role, so the specialty occupation analysis restarts.
What prevailing wage level applies to most HR Business Partner positions?
Most HRBP roles fall at DOL wage Level II or Level III, depending on whether the role is entry-level strategic or involves independent judgment and management responsibilities. Your employer's LCA must certify a wage at or above the prevailing level for your SOC code and geographic area. You can verify the applicable range using the OFLC Wage Search before negotiations begin.
Does the H-1B cap lottery affect my chances of getting sponsored for an HRBP role?
If your target employer is a standard for-profit company, your petition enters the annual H-1B cap, which is subject to a lottery when registrations exceed 85,000. Cap-exempt employers, including universities and qualifying nonprofits, can file year-round outside the lottery. Timing your job search to align with the April registration window, or targeting cap-exempt organizations, directly affects when you can start.
