HR Generalist roles qualify for H-1B sponsorship when the position requires a bachelor's degree in human resources, business administration, or a related field. Employers filing LCAs for HR Generalists must certify a prevailing wage through the DOL, making companies with active H-1B filing history your strongest targets.

Verify your degree meets specialty occupation
USCIS requires an HR Generalist role to demand a specific bachelor's degree, not just any degree. Pull the O*NET profile for your job code and confirm the educational requirement aligns with your credential before applying.
Target companies with LCA filing history
Search Migrate Mate to filter HR Generalist roles by employers who have already filed Labor Condition Applications for this occupation code, cutting out companies that have never sponsored HR professionals.
Check prevailing wage before negotiating offers
Your offered salary must meet the DOL prevailing wage for your specific HR Generalist SOC code and work location. Run the OFLC Wage Search before accepting an offer to confirm the number clears the wage level threshold.
Ask employers about H-1B cap timing early
H-1B petitions are capped at 65,000 per fiscal year, with registration opening in March. Raise sponsorship timing with hiring managers before final interviews so both sides can plan around the April 1 filing window.
Prepare an HR credential portfolio for RFEs
HR Generalist petitions draw Requests for Evidence when the role description looks too broad. Document your SHRM certification, degree transcripts, and a detailed job duties breakdown showing the position requires specialized HR knowledge.
Identify E-Verify enrolled employers strategically
Companies enrolled in E-Verify are already familiar with employment eligibility compliance. Cross-referencing your target list against E-Verify-enrolled employers signals institutional readiness to handle your H-1B work authorization documentation.

Find HR Generalist JobsHR Generalist H-1B Visa: Frequently Asked Questions
Does an HR Generalist role qualify as a specialty occupation for H-1B?
It can, but the burden is on the employer to prove the position requires a specific bachelor's degree. Broad HR Generalist descriptions that accept any degree field weaken the petition. Employers strengthen cases by specifying a degree in human resources, organizational behavior, or business administration and tying job duties to that academic background.
Which employers commonly sponsor H-1B visas for HR Generalist positions?
Large corporations, healthcare systems, and consulting firms with dedicated HR departments file the most LCAs for HR Generalists. Migrate Mate lets you search by occupation code to see which specific employers have active H-1B filing history for this role, so you're targeting companies with a demonstrated willingness to sponsor.
Can an HR Generalist change employers mid-H-1B using portability?
Yes. Under AC21 portability rules, you can transfer your H-1B to a new employer in a same or similar HR occupation after your petition has been pending for 180 days. Your new employer must file an H-1B transfer petition, and you can start work as soon as USCIS receives it, not after approval.
What SOC code applies to HR Generalist roles for LCA purposes?
Most HR Generalist positions file under SOC code 13-1071, Human Resources Specialists. Some employers use 11-3121 for HR Managers if the role carries supervisory duties. The SOC code determines your prevailing wage level, so confirming the correct classification with your employer before LCA filing directly affects your required minimum salary.
What documents should you prepare for an H-1B petition as an HR Generalist?
You'll need official transcripts showing your relevant degree, any SHRM or HRCI certifications, a detailed position description mapping duties to your educational background, and proof of prior HR employment if your employer is relying on work experience. USCIS scrutinizes HR Generalist petitions closely, so a vague job description letter from your employer is the most common reason for a Request for Evidence.
