Verify your degree supports specialty occupation
USCIS requires your bachelor's degree to directly relate to HR functions. A degree in business administration, psychology, or organizational management typically qualifies. A general arts degree without HR coursework can trigger an RFE, so document how your major maps to the role.
Target employers with LCA filing history
Search the OFLC Wage Search to confirm a company has filed LCAs for HR Assistant roles before applying. Employers who've sponsored this occupation before already understand the process, which shortens the timeline between offer and petition.
Use Migrate Mate to filter H-1B sponsoring employers
Filter your search on Migrate Mate to surface companies with verified H-1B filing history in HR roles. This removes employers who've never sponsored the occupation, so you spend time on applications with a realistic path to sponsorship.
Ask about E-Verify enrollment before accepting an offer
Confirm the employer is enrolled in E-Verify during negotiations, not after signing. STEM OPT and cap-gap situations both require it, and an employer who isn't enrolled may delay or derail your authorization timeline if you're bridging statuses.
Look up the prevailing wage for your specific metro area
HR Assistant prevailing wages vary significantly by location and experience level. Pull the Level I and Level II rates for your city using the OFLC Wage Search before salary negotiations so you know what the DOL-certified floor requires your employer to offer.

Find Human Resources Assistant JobsHuman Resources Assistant H-1B Visa: Frequently Asked Questions
Does an HR Assistant role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires the role to normally require a bachelor's degree in a specific field, such as human resources, business administration, or organizational development. A generalist support role with loosely defined duties is more likely to receive an RFE than one with a detailed job description tied to a degree-specific knowledge requirement.
Which types of employers most commonly sponsor H-1B visas for HR Assistants?
Large healthcare systems, universities, financial institutions, and multinational corporations file LCAs for HR Assistant roles with the most regularity. These organizations have in-house immigration counsel and established sponsorship workflows. Smaller companies or startups can sponsor too, but they often lack the administrative infrastructure to move quickly, which matters when you're working against an OPT expiration or cap deadline. You can browse verified sponsoring employers on Migrate Mate.
What documents should I prepare before asking an employer to sponsor my H-1B?
Have your academic transcripts, diploma, and a credential evaluation ready if your degree is from outside the U.S. You'll also need your current I-94 record, any prior visa approval notices, and a detailed description of your HR duties that maps clearly to your degree field. Providing these upfront speeds up the employer's review and reduces back-and-forth with their immigration attorney.
Can I switch HR Assistant jobs after my H-1B is approved?
Yes, but the new employer must file an H-1B transfer petition before your last day at the sponsoring company. Portability under AC21 lets you start with the new employer once the transfer petition is filed and receipted, as long as the new role is in the same or a similar occupational classification. HR Assistant to HR Generalist typically qualifies as same-SOC-code portability.
How does the H-1B lottery affect my job search timeline as an HR professional?
The annual H-1B cap opens for registration in March, with a lottery in late March for fiscal year starting October 1. If you're on OPT and not selected, cap-gap protections extend your work authorization through September 30. Planning your job search to land an offer by February gives your employer enough runway to prepare the petition before the registration window closes.
