Map your degree to the role
USCIS requires a direct relationship between your degree field and HR Director duties. A degree in human resources management or organizational development is the cleanest fit. Industrial psychology or business administration with an HR concentration can work, but expect your employer to document the connection explicitly.
Verify prevailing wage before negotiating
Use the OFLC Wage Search to look up the Level III or IV prevailing wage for HR Director under SOC code 11-3121 in your target city. Your employer's LCA must certify at least that wage, so knowing the floor before salary discussions prevents surprises during filing.
Target employers with dedicated HR leadership
Companies large enough to have a standalone HR Director position rather than a combined HR-operations role are more likely to have immigration infrastructure in place. Look for employers with in-house HR teams or established relationships with immigration counsel, since complex leadership roles draw closer USCIS scrutiny.
Find H-1B sponsoring employers on Migrate Mate
Filter by HR Director roles on Migrate Mate to see which employers have active LCA filing history for this occupation. That history signals both sponsorship willingness and familiarity with the DOL wage certification process specific to senior HR positions.
Clarify PERM implications early
If the employer intends to sponsor you for permanent residence after the H-1B, HR Director is a category where PERM recruitment requirements can be complex. Ask during the offer stage whether the employer has run PERM for senior HR roles before, since the process requires demonstrating no qualified U.S. workers were available.
Request premium processing from your employer
HR Director positions are often filled with urgent timelines, and the standard H-1B adjudication window can stretch several months. USCIS offers premium processing that guarantees a decision within 15 business days. Confirm your employer will elect it before you resign from a current position.
H-1B Visa HR Director: Frequently Asked Questions
Does an HR Director role qualify as a specialty occupation for H-1B purposes?
Yes, provided the employer requires at least a bachelor's degree in a specific field such as human resources, business administration, or organizational development for the position. USCIS looks at whether the degree requirement is standard across the industry for this role. Generic job postings that list a degree as preferred rather than required can create RFE risk, so the job description language matters significantly.
How does the DOL prevailing wage requirement affect HR Director sponsorship?
Before filing your H-1B petition, your employer must submit a Labor Condition Application certifying they'll pay you at least the DOL prevailing wage for HR Director in your work location. The relevant SOC code is 11-3121. Prevailing wages vary substantially by metro area and experience level. You can cross-reference the employer's intended offer against current DOL wage levels using the OFLC Wage Search.
Are large corporations or smaller companies more likely to sponsor H-1B visas for HR Directors?
Both sponsor, but for different reasons. Large corporations with global workforces often need HR Directors experienced with international employment law and already have immigration infrastructure. Mid-size companies in high-growth sectors can also be strong sponsors, particularly if they're scaling rapidly and need senior HR leadership. You can identify employers with verified H-1B LCA filing history for this role on Migrate Mate.
Can I switch HR Director jobs while on H-1B without losing my status?
Yes, H-1B portability under AC21 lets you change employers after your petition has been pending or approved for at least 180 days, as long as the new role is in the same or a similar occupational classification. For HR Directors, a move between comparable senior HR leadership roles typically qualifies. Your new employer must file a transfer petition before you start, and you can begin work as soon as USCIS receives it.
How does the H-1B cap lottery affect HR Director job seekers?
Most HR Director positions at for-profit companies are subject to the annual H-1B cap of 65,000 regular visas plus 20,000 for U.S. master's degree holders, with selection by lottery each April. Cap-exempt employers include universities, nonprofit research organizations, and government entities. If you're currently on OPT or another status, timing your job search to align with the USCIS registration window in March is critical.
