Verify your degree supports specialty occupation
Your bachelor's degree field must align directly with insurance sales consulting work. Business, finance, risk management, and economics degrees typically qualify. A general studies or unrelated degree can trigger an RFE, so confirm the connection before applying.
Look up prevailing wages before negotiating
Use the OFLC Wage Search to find the Level I through Level IV wage for insurance sales consultants in your target metro. Your offered salary must meet or exceed the certified LCA wage, so knowing the threshold before interviews protects your negotiating position.
Target carriers with E-Verify enrollment
Insurance employers enrolled in E-Verify are already set up to verify work authorization electronically, which signals readiness to sponsor. Ask recruiters directly whether the company is E-Verify enrolled before investing time in multi-round interviews.
Search verified H-1B sponsors on Migrate Mate
Filter your search by occupation on Migrate Mate to surface insurance carriers and brokerages with confirmed H-1B LCA filing history. This cuts out companies that won't sponsor before you apply, saving weeks in your job search.
Understand how commission structures affect your LCA wage
Many insurance sales roles are commission-heavy. DOL requires the LCA wage guarantee to cover your base salary alone, not projected commissions. Confirm your base meets the prevailing wage before signing an offer letter to avoid a deficient LCA filing.
File H-1B cap registration by the March deadline
USCIS opens H-1B cap registration each March. If you're on OPT, coordinate with your sponsoring employer so they submit your registration before the window closes. Missing registration means waiting another full year regardless of how strong your offer is.
H-1B Visa Insurance Sales Consultant: Frequently Asked Questions
Does an Insurance Sales Consultant role qualify as a specialty occupation for H-1B purposes?
Yes, if the employer requires a bachelor's degree or higher in a specific field like finance, business administration, risk management, or economics as a minimum condition for the role. If the job description allows any degree or no degree, USCIS may challenge the specialty occupation claim. Ensure the job posting and offer letter state the specific degree requirement clearly.
How do I find insurance employers who actually sponsor H-1B visas?
Check DOL LCA disclosure data to see which carriers and brokerages have filed Labor Condition Applications for insurance sales roles in recent years. Migrate Mate surfaces this employer-level filing history by occupation, so you can identify active H-1B sponsors before you apply rather than discovering sponsorship limitations late in the process.
Can a commission-based insurance sales role still meet H-1B prevailing wage requirements?
Yes, but only if your guaranteed base salary meets or exceeds the DOL prevailing wage for the occupation and location certified on the LCA. Commissions and bonuses don't count toward the wage guarantee. Employers must pay the LCA wage whether or not you hit sales targets, so confirm the base salary threshold using the OFLC Wage Search before accepting an offer.
Does holding an insurance license affect my H-1B eligibility as a sales consultant?
State insurance licenses are a job requirement, not an H-1B eligibility factor. USCIS evaluates specialty occupation based on your academic credentials, not professional licenses. That said, you'll need an active state license to work legally in the role, so factor in the timing of license transfers or new-state applications when planning your start date with a sponsoring employer.
What happens to my H-1B status if my insurance employer changes my role from salaried to fully commissioned?
A shift to full commission with no guaranteed base could violate the LCA wage requirement, which is a serious compliance issue for your employer and your status. Any material change to your compensation structure, job duties, or work location may require your employer to file an amended H-1B petition with USCIS before the change takes effect.
