Align your degree to the role
USCIS scrutinizes whether your specific degree field directly supports a Legal Business Associate position. A degree in legal studies, business law, or paralegal studies strengthens your petition far more than a general business degree alone.
Search LCA filing history on Migrate Mate
Pull DOL Labor Condition Application data by employer and occupation code to see which law firms and corporate legal departments have actively filed for roles matching Legal Business Associate before targeting your applications.
Target law firm operations and compliance teams
Legal Business Associate roles in AmLaw 100 firms and in-house legal departments at financial institutions file H-1B petitions more consistently than smaller practices. Filter your search by employer type before spending time on applications.
Get your credentials evaluated early
If your law or business degree is from outside the U.S., obtain a credential evaluation that maps your qualifications to the U.S. bachelor's equivalent. USCIS officers reference this during specialty occupation review, and missing it delays filings.
Clarify the job description before the offer stage
Legal Business Associate is a hybrid title. Ask the employer to specify whether the role is classified under legal operations, paralegal support, or compliance in the LCA filing. The SOC code the employer selects directly affects your prevailing wage requirement.
Negotiate the filing timeline into your offer
H-1B cap-subject petitions must be filed by April 1 for an October 1 start date. If you're between OPT and H-1B status, confirm your employer's timeline for filing before you accept, so your cap-gap coverage doesn't lapse.
H-1B Visa Legal Business Associate: Frequently Asked Questions
Does a Legal Business Associate role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires that the role normally requires at least a bachelor's degree in a specific field. A Legal Business Associate role that requires a degree in legal studies, business law, or paralegal studies typically qualifies. A role that accepts any bachelor's degree regardless of field is harder to approve. The employer's job description and the LCA occupation code both factor into the determination.
Which types of employers sponsor H-1B visas for Legal Business Associate positions?
Law firms with large operations or litigation support teams, corporate legal departments at financial services and technology companies, and compliance-focused organizations in regulated industries are the most consistent H-1B sponsors for this role. You can browse employers with verified LCA filing history for Legal Business Associate positions on Migrate Mate, which surfaces DOL disclosure data by employer and occupation.
How does prevailing wage apply to Legal Business Associate H-1B filings?
The employer must certify on the LCA that they'll pay you at or above the prevailing wage for your occupation and work location. The prevailing wage is set by DOL based on the SOC code the employer assigns to your role. You can look up the applicable wage level for your city using the OFLC Wage Search tool before your offer stage to verify the number the employer uses is consistent with your location and experience level.
Can I use OPT STEM extension to bridge into an H-1B as a Legal Business Associate?
STEM OPT extension is only available if your degree falls under a STEM-designated field and your employer is enrolled in E-Verify. Most legal studies and paralegal programs are not on the STEM designation list, so STEM OPT extension isn't available for the majority of Legal Business Associate candidates. Standard OPT gives you 12 months of authorization, and if you're selected in the H-1B lottery, cap-gap coverage extends your OPT through September 30 of the cap year.
What SOC code is typically used for Legal Business Associate H-1B filings?
Employers most commonly file Legal Business Associate LCAs under SOC 23-2011 (Paralegals and Legal Assistants) or 13-1199 (Business Operations Specialists, All Other), depending on whether the role skews toward legal support or operational functions. The SOC code the employer selects affects your prevailing wage level and how USCIS evaluates specialty occupation. Review the O*NET occupation profile for each code to confirm the one that best matches your actual job duties before the LCA is filed.
