Verify your license transfers across states
H-1B approval depends partly on your ability to legally practice at the worksite. Confirm your clinical license is valid in the employer's state before accepting an offer, since licensing reciprocity varies and delays can stall your petition.
Use OFLC Wage Search before negotiating
Your employer must pay at least the prevailing wage for your occupation and location. Pull the Level I through Level IV wage data from OFLC Wage Search for your specific SOC code so you can negotiate from an informed baseline.
Target employers with cap-exempt status
Nonprofits affiliated with universities or government research programs can file H-1B petitions outside the annual lottery cap. Community mental health centers with 501(c)(3) status tied to a qualifying institution are worth prioritizing in your search.
Search verified H-1B sponsors on Migrate Mate
Filter mental health roles by employers with confirmed H-1B LCA filing history on Migrate Mate. This surfaces hospitals, behavioral health networks, and telehealth companies that have already sponsored the visa type you need.
Confirm the role meets specialty occupation requirements
USCIS scrutinizes mental health positions where a bachelor's degree isn't universally required. Check the O*NET profile for your exact job title to document that a degree in psychology, social work, or counseling is a standard industry requirement.
Request premium processing before your OPT expires
USCIS offers 15-business-day adjudication through premium processing. If you're on OPT with a firm end date, ask your employer to upgrade the filing early enough that a Request for Evidence doesn't leave you without authorization.
H-1B Visa Mental Health: Frequently Asked Questions
Do mental health counselor roles qualify as H-1B specialty occupations?
Most do, but the employer must show the position normally requires a bachelor's degree or higher in a specific field such as counseling, clinical psychology, or social work. USCIS has issued Requests for Evidence on broadly worded mental health job descriptions, so the offer letter should specify the degree requirement explicitly and connect it to the role's clinical duties.
How do I find mental health employers who actively sponsor H-1B visas?
Migrate Mate filters mental health job listings by employers with verified H-1B LCA filing history, so you're not guessing which organizations are willing to sponsor. Hospital systems, federally qualified health centers, and large telehealth platforms tend to have the most consistent sponsorship track records in behavioral health.
Can a nonprofit mental health clinic sponsor my H-1B without the lottery?
Yes, if the organization qualifies as cap-exempt. Nonprofits affiliated with a university, government research institution, or those that meet the primary purpose test under INA can file H-1B petitions at any time without entering the annual lottery. Ask a prospective employer directly whether they've filed cap-exempt petitions before and whether their nonprofit status qualifies.
What happens to my H-1B if I transfer to a different mental health employer?
Your new employer must file an H-1B transfer petition with USCIS before your start date. Under portability rules established by AC21, you can begin working for the new employer once the transfer petition is received by USCIS, as long as your prior H-1B was approved and you've maintained valid status. Your clinical license must also be valid in the new worksite state.
Does a master's degree in social work or counseling strengthen an H-1B petition for mental health roles?
It can, particularly when USCIS questions whether a position genuinely requires a specialized degree. A master's degree aligned to the role, combined with a state clinical license such as an LCSW or LPC, creates a stronger record that the job demands graduate-level training in a specific field, reducing the likelihood of a Request for Evidence.
