H-1B Visa Mental Health Therapist Jobs
Mental Health Therapist roles qualify for H-1B sponsorship as specialty occupations requiring at least a master's degree in counseling, social work, or a related clinical field. Employers in community health, hospital systems, and group practices sponsor H-1B petitions for licensed therapists, though licensure requirements vary by state and add a credential step most applicants underestimate.

Verify your degree meets specialty occupation standards
USCIS requires a directly related degree for H-1B approval. A master's in counseling or clinical psychology maps cleanly, but a general psychology bachelor's alone won't qualify. Check the O*NET profile for Mental Health Therapist to confirm the degree field alignment before applying.
Obtain state licensure before your H-1B starts
Most employers require an active license before they'll file your H-1B petition. Provisional or associate licenses may not satisfy the specialty occupation requirement. Confirm the licensing board's timeline in your target state and factor that into your job search start date.
Target employers with E-Verify enrollment already active
H-1B employers must be E-Verify participants. Community mental health centers, federally qualified health centers, and hospital-affiliated outpatient programs typically meet this requirement. Smaller private practices often don't, so ask about E-Verify status early in conversations.
Search H-1B filing history on Migrate Mate
Filter for Mental Health Therapist roles on Migrate Mate to see which employers have active DOL Labor Condition Application filings for this occupation. That history tells you which organizations have already navigated the sponsorship process for this role type.
Confirm your prevailing wage level matches your offer
Use the OFLC Wage Search to look up prevailing wages for your SOC code and work location before negotiating. Your offered salary must meet at least the Level I wage for that area. A below-prevailing offer triggers a DOL compliance issue before your petition even reaches USCIS.
Clarify who covers the H-1B filing fees upfront
The I-129 petition fee and the ACWIA training fee are legally the employer's responsibility and can't be deducted from your wages. Raise this in the offer stage, not after you've signed, so there are no surprises when the petition is filed.

Find Mental Health Therapist JobsMental Health Therapist H-1B Visa: Frequently Asked Questions
Does a Mental Health Therapist role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a master's degree in a directly related field such as clinical counseling, marriage and family therapy, or social work. USCIS evaluates both the job requirements and the applicant's credentials. Roles where a bachelor's degree in any field is accepted won't meet the specialty occupation standard, so the job description language matters significantly.
Do I need a state license before an employer will file my H-1B petition?
Most employers require an active, unrestricted state license before initiating the H-1B process because licensure is typically listed as a minimum qualification in the job description. Some states issue provisional licenses that allow supervised practice while you complete full licensure requirements. Confirm whether your target employer will accept a provisional license, and map out the licensing timeline for your state before committing to a start date.
Which types of employers are most likely to sponsor H-1B visas for therapists?
Hospital systems, federally qualified health centers, community mental health organizations, and large group practices with dedicated HR infrastructure sponsor H-1B petitions more consistently than small private practices. Employers already enrolled in E-Verify and with prior LCA filings for clinical roles are the fastest path to sponsorship. Migrate Mate lets you filter for employers with verified H-1B filing history in mental health occupations.
Can a foreign-trained therapist qualify for H-1B sponsorship without a U.S. degree?
Yes, but USCIS must determine that your foreign degree is equivalent to a U.S. master's degree in a directly related field. You'll typically need a credential evaluation from a NACES-member organization, and the equivalency must match the specific field, not just the level. A degree in an unrelated discipline won't satisfy the specialty occupation requirement even if it's a master's or doctoral credential.
What happens to my H-1B status if my employer loses their contract with a mental health program?
If your employer terminates your H-1B before the petition end date, you have a 60-day grace period to find a new sponsoring employer, file a change of status, or leave the country. A new employer can file an H-1B transfer petition while you remain in the U.S. Your status is tied to that specific employer, not to your license or your clinical role in general.
