Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Neurosurgeon
Verify your ECFMG certification before applying
International medical graduates must hold current ECFMG certification to enter U.S. residency and fellowship programs. Confirm your certification status is active and unrestricted before any employer can file your H-1B petition, since USCIS requires it as primary evidence of foreign medical training.
Target academic medical centers with cap-exempt status
Hospitals affiliated with universities or nonprofit research institutions are often cap-exempt H-1B employers, meaning they can file year-round without competing in the lottery. Search Migrate Mate to filter neurosurgeon openings by employers with verified H-1B LCA filing history.
Check prevailing wage levels before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your neurosurgery subspecialty and practice location. Use the OFLC Wage Search to look up the Level I through Level IV wage tiers for SOC code 29-1242 before you receive a formal offer.
Confirm fellowship completion aligns with H-1B filing windows
H-1B cap-subject petitions can only be filed for an October 1 start date, and USCIS opens registration in March. If your fellowship ends in June or July, coordinate with your sponsoring employer to file during the prior March registration cycle to avoid a gap in authorized status.
Request employer-paid premium processing for time-sensitive credentialing
Hospital credentialing committees often require an approved H-1B before granting surgical privileges. Confirm in writing that your employer will file with premium processing so USCIS adjudicates the I-129 within 15 business days, preventing delays between your contract start date and your first scheduled procedure.
Document subspecialty training to satisfy specialty occupation evidence
USCIS scrutinizes neurosurgery petitions where the role description is broad. Provide fellowship certificates, board examination results, and a detailed employer letter specifying the subspecialty focus, such as spine, pediatric, or vascular neurosurgery, to clearly establish that the degree requirement is tied to the specific duties.

Find Neurosurgeon JobsNeurosurgeon H-1B Visa: Frequently Asked Questions
Does a neurosurgeon role qualify as an H-1B specialty occupation?
Yes. Neurosurgery requires a medical degree, completion of a seven-year neurosurgical residency, and in most cases subspecialty fellowship training, all of which satisfy the USCIS specialty occupation standard. The role is classified under SOC code 29-1242, and USCIS consistently recognizes it as qualifying. Your employer documents this in the I-129 petition by describing the specific duties and degree requirements.
Can a neurosurgeon avoid the H-1B lottery?
Many neurosurgeons can. Academic medical centers, teaching hospitals, and nonprofit research institutions affiliated with universities are frequently cap-exempt H-1B employers. Cap-exempt employers can file petitions at any time of year without entering the annual lottery. To identify which employers hold this status, look for institutions classified as institutions of higher education or affiliated nonprofit entities under USCIS guidelines.
How do I find neurosurgeon employers that actively sponsor H-1B visas?
Migrate Mate lists neurosurgeon openings filtered by employers with verified H-1B LCA filing history, so you can identify hospital systems and academic medical centers that have sponsored the visa in practice, not just those claiming willingness. Reviewing an employer's actual DOL filing record before you apply saves significant time in the recruitment process.
What documentation does my employer need to file my H-1B petition?
Your employer files a Labor Condition Application with DOL before submitting Form I-129 to USCIS. Supporting documents typically include your medical school diploma, ECFMG certificate for international graduates, residency and fellowship completion letters, board certification or examination results, a copy of your state medical license, and a detailed offer letter describing the subspecialty duties and the degree requirements tied to them.
Can I start practicing while my H-1B petition is pending?
Only if you already hold valid work authorization, such as J-1 or a prior H-1B status that remains current. A pending I-129 petition alone does not grant work authorization. If you're changing status from J-1 to H-1B, work cannot begin until USCIS approves the petition and your status changes, which is why employers often request premium processing to avoid gaps between your contract start date and approval.
