H-1B Visa Pediatric Surgeon Jobs
Pediatric surgeons rank among the most H-1B-dependent specialties in U.S. medicine. Most positions are at children's hospitals, academic medical centers, and large health systems with established immigration programs, meaning your employer will typically file the I-129 petition, cover ACWIA training fees, and manage LCA certification with the DOL before your start date.

Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Pediatric Surgeon
Get your credentials evaluated before applying
Foreign medical degrees must be evaluated by a USCIS-recognized credential evaluation service before your employer files the H-1B petition. An equivalency determination to a U.S. M.D. or D.O. is required to satisfy the specialty occupation standard for surgical roles.
Target children's hospitals with cap-exempt status
Many children's hospitals qualify as nonprofit research or teaching institutions, making them cap-exempt H-1B employers. You can start any time of year without waiting for the April lottery, which matters when fellowship programs end mid-year.
Search verified H-1B sponsors on Migrate Mate
Filter by specialty and location on Migrate Mate to find pediatric surgery employers with active H-1B LCA filing history. Seeing which hospitals have filed for surgical roles tells you which HR and legal teams already know the process.
Confirm your employer will cover ACWIA fees
DOL rules require employers, not physicians, to pay the American Competitiveness and Workforce Improvement Act training fee on H-1B petitions. Confirm this in writing before signing an offer letter, as some smaller surgical groups try to shift costs incorrectly.
Align your LCA wage level with your actual role
USCIS scrutinizes whether the prevailing wage level on the LCA matches a fully independent attending surgeon, not a supervised resident or fellow. Use OFLC Wage Search to verify your offered wage matches Level III or IV for the correct SOC code before your employer submits.
File for premium processing when timing is critical
If your fellowship ends and your H-1B start date is tight, ask your employer to request premium processing with USCIS, which guarantees a decision within 15 business days. Standard processing can stretch several months and create an authorization gap.

Find Pediatric Surgeon JobsPediatric Surgeon H-1B Visa: Frequently Asked Questions
Does a pediatric surgery fellowship affect my H-1B eligibility?
Completing a fellowship in the U.S. doesn't automatically transfer into H-1B status. If your fellowship was on J-1, you may be subject to a two-year home residency requirement, which blocks H-1B status unless you obtain a waiver through a state health agency, the Conrad 30 program, or another federal waiver route. Confirm your J-1 terms before accepting a staff position.
Which types of employers sponsor H-1B visas for pediatric surgeons?
Children's hospitals, academic medical centers, and large integrated health systems are the most consistent H-1B sponsors for pediatric surgeons. Many qualify as cap-exempt institutions, letting them file petitions year-round. Smaller private surgical practices occasionally sponsor but are less likely to have in-house immigration counsel. Migrate Mate shows employers with verified H-1B LCA filing history so you can target the right organizations.
Can my employer transfer my H-1B if I switch pediatric surgery positions?
Yes. Under H-1B portability rules, you can begin working for a new employer as soon as they file a new I-129 petition, without waiting for approval, as long as your prior H-1B was approved and you've maintained valid status. The new employer must still file an LCA with the DOL and meet prevailing wage requirements for the new position.
Does pediatric surgery qualify as a specialty occupation for H-1B purposes?
Yes. Pediatric surgery requires a medical degree, residency, and subspecialty fellowship training, which satisfies USCIS's specialty occupation requirement that the role normally requires at least a bachelor's degree in a specific field. The O*NET profile for surgeons lists a doctorate-level job zone, which supports the specialty occupation classification in the petition.
What happens to my H-1B status if my hospital loses its nonprofit designation?
If your employer filed as a cap-exempt nonprofit or teaching hospital and later loses that designation, it doesn't automatically invalidate your existing H-1B approval. However, any extension or amendment petition would need to be filed as cap-subject, meaning it would require a lottery slot. Confirm your employer's ongoing cap-exempt status before each renewal cycle.
