Frame your role as specialty occupation
USCIS requires a direct link between your degree field and the job duties. Document how your HR or organizational psychology degree maps to strategic workforce planning, compensation analysis, and organizational design, not just generalist HR administration.
Target employers with active LCA filing history
Use Migrate Mate to filter People Business Partner roles by employers who have filed Labor Condition Applications for this title. Past LCA filings signal an established H-1B sponsorship process, reducing your risk of an employer learning the basics on your petition.
Verify your wage level before accepting an offer
Your offer must meet the DOL prevailing wage for your location and job zone. Run the OFLC Wage Search using SOC code 11-3121 before negotiations close, a wage below Level II or III can trigger an RFE or force a renegotiation after filing starts.
Distinguish your duties from generalist HR coordinator roles
USCIS scrutinizes HR titles for specialty occupation. Your job description should emphasize business unit alignment, talent strategy, succession planning, and data-driven workforce decisions, duties that clearly require a bachelor's degree in HR, psychology, or business.
Confirm cap-exempt status if your employer qualifies
Nonprofits, universities, and government research organizations are cap-exempt, meaning your petition bypasses the lottery entirely. If you're targeting HR roles in higher education or research institutions, filing can happen year-round without waiting for the April registration window.
Time your start date around the H-1B cap gap
If you're transitioning from F-1 OPT, your employment authorization extends through September 30 under cap-gap rules even if your EAD expires earlier. Confirm your employer understands this so they don't pause onboarding while your petition is pending approval.
H-1B Visa People Business Partner: Frequently Asked Questions
Does a People Business Partner role qualify as an H-1B specialty occupation?
Yes, provided the job duties require a specific bachelor's degree and go beyond generalist HR tasks. Roles focused on strategic workforce planning, organizational design, and business unit partnership typically meet the specialty occupation standard. USCIS looks for a direct and logical connection between the degree field and the position's core responsibilities, so your offer letter and job description need to reflect that.
Which employers sponsor H-1B visas for People Business Partner roles?
Employers in technology, financial services, healthcare systems, and large professional services firms sponsor this title most consistently. These organizations maintain dedicated HR business partner functions at scale and have existing H-1B infrastructure. You can search verified H-1B-sponsoring employers hiring for this role on Migrate Mate, which surfaces companies with active LCA filing history for People Business Partner positions.
What SOC code applies to People Business Partner positions for H-1B purposes?
Most People Business Partner roles fall under SOC code 11-3121, Human Resources Managers, or 13-1071, Human Resources Specialists, depending on the seniority and scope of the position. The SOC code determines the DOL prevailing wage tier, which directly sets the minimum salary your employer must certify on the Labor Condition Application. You can verify the appropriate classification using O*NET before your employer files.
Can a People Business Partner petition be denied for not meeting specialty occupation?
Yes. USCIS has issued RFEs and denials for HR titles when the job description lists duties that don't require a specific degree, for example, administering benefits, processing paperwork, or conducting generalist onboarding. The strongest petitions emphasize strategic responsibilities: organizational diagnostics, leadership coaching, workforce analytics, and cross-functional business alignment. A vague or broad job description is the most common source of scrutiny.
How does the H-1B lottery affect the hiring timeline for this role?
If your employer is cap-subject, USCIS opens H-1B registration in March and selects petitions by lottery. If selected, your earliest employment start date is October 1. Cap-exempt employers, including universities and qualifying nonprofits, can file year-round without a lottery. Employers new to H-1B sponsorship sometimes underestimate this timeline, so it's worth clarifying early in the interview process whether they've sponsored before and whether they understand the April filing window.
