Verify your role meets specialty occupation
USCIS scrutinizes People Operations roles more than technical positions. Pull the O*NET profile for HR Managers to document that your specific duties require a directly related bachelor's degree, not just any degree.
Target employers with active LCA filings
Use Migrate Mate to filter People Operations Manager openings by employers who have certified Labor Condition Applications for HR titles. This confirms the employer has already navigated DOL prevailing wage requirements for the role.
Confirm prevailing wage before the offer stage
Run your target job title and location through the OFLC Wage Search before you negotiate. DOL sets four wage levels for HR Managers, and your offer must meet at least Level I or your employer's LCA will be rejected.
Ask whether the employer uses a staffing or PEO model
H-1B sponsorship for People Operations roles gets complicated when a professional employer organization is the legal employer of record. USCIS requires the petitioning entity to control your day-to-day work, so clarify this before accepting an offer.
Document systems expertise in your petition materials
USCIS RFEs on People Operations petitions often challenge whether the role genuinely requires a specialized degree. Your resume and support letter should tie your HRIS, benefits administration, or workforce planning work directly to your degree field.
File premium processing if your start date is firm
USCIS standard processing for I-129 petitions can run several months. If your employer sets a definite start date, premium processing upgrades USCIS adjudication to 15 business days and protects you against delays that would void your offer.
H-1B Visa People Operations Manager: Frequently Asked Questions
Does a People Operations Manager role qualify as a specialty occupation for H-1B purposes?
Yes, but the petition needs to be built carefully. USCIS requires that the role normally requires a bachelor's degree in a specific field such as human resources, organizational psychology, or business administration. Generic management duties can trigger an RFE, so the job description and support letter must tie each core responsibility directly to a specialized body of knowledge.
Which types of employers sponsor H-1B visas for People Operations Manager positions?
Technology companies, healthcare systems, financial services firms, and large professional services organizations are the most consistent H-1B sponsors for People Operations roles. These employers typically have in-house immigration counsel and established HR compliance infrastructure. You can browse verified H-1B sponsoring employers hiring for this title on Migrate Mate, filtered by LCA filing history.
How does the H-1B prevailing wage requirement affect People Operations Manager offers?
DOL requires your employer to pay at least the prevailing wage for HR Managers in your specific metro area, as determined by the OFLC Wage Search. The wage level assigned to your role, from Level I for entry-level to Level IV for senior positions, directly shapes your minimum offer. Employers who underpay relative to your actual seniority risk DOL audits and LCA decertification.
Can a People Operations Manager transfer their H-1B to a new employer mid-status?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as the new I-129 petition is filed with USCIS, as long as your previous H-1B was approved and you've maintained lawful status. The new employer must file a new LCA with DOL and a new I-129 petition before or on your start date. You don't need to wait for approval to begin work.
What makes a People Operations Manager petition more likely to receive an RFE?
USCIS issues RFEs on these petitions most often when the job description includes duties that don't require a specific degree, such as general administrative oversight or employee relations tasks that a non-specialist could perform. Employers can reduce RFE risk by drafting job descriptions that emphasize HR technology implementation, compliance program management, or workforce analytics, and by tying each duty to a relevant academic discipline.
