Frame your degree for specialty occupation
USCIS adjudicators scrutinize whether Prompt Engineer roles meet the specialty occupation standard. A degree in linguistics, computer science, or cognitive science strengthens your petition more than a general business degree, even if your work history is identical.
Check prevailing wages before negotiating salary
Use the OFLC Wage Search to look up the prevailing wage for your specific job zone and metro area. Your offered salary must meet the DOL-certified wage level, and undershooting it delays or sinks LCA certification.
Target employers with AI research divisions
Companies with dedicated NLP, large language model, or AI safety teams file H-1B petitions for Prompt Engineers far more consistently than generalist software shops. Search Migrate Mate to filter employers by verified LCA filing history in this occupation.
Verify your employer is E-Verify enrolled
H-1B employers are required to participate in E-Verify. Confirm enrollment before accepting an offer. If an employer isn't enrolled, they can't legally proceed with your H-1B petition, and you'd be back to square one after cap registration.
Document model outputs as portfolio evidence
USCIS RFEs for emerging AI roles often challenge whether the position genuinely requires a specialized degree. A portfolio of prompt engineering artifacts, benchmark results, and system architecture decisions tied to your academic training helps rebut that challenge.
Understand the October 1 activation gap
H-1B cap petitions approved in April don't activate until October 1. If you're transitioning off OPT, confirm your OPT end date and cap-gap eligibility with your DSO so there's no unauthorized employment gap between the two statuses.
H-1B Visa Prompt Engineer: Frequently Asked Questions
Does Prompt Engineer qualify as a specialty occupation for H-1B purposes?
Yes, provided the role requires at least a bachelor's degree in a directly related field such as computer science, computational linguistics, or artificial intelligence. USCIS evaluates the job duties, not just the title. Roles focused on designing, evaluating, and iterating prompts for large language models in production environments have been approved, but employers should document the theoretical and practical knowledge the position requires.
Which employers sponsor H-1B visas for Prompt Engineers?
Technology companies with active large language model development teams, AI research labs, and enterprise software firms integrating generative AI into their products are the most consistent sponsors. You can search Migrate Mate to browse verified H-1B sponsoring employers filtered specifically for Prompt Engineer and related AI roles, using DOL Labor Condition Application filing data.
What degree field best supports an H-1B petition for this role?
Computer science, computational linguistics, cognitive science, and data science are the strongest matches because they map directly to the technical knowledge required. A general business or communications degree will likely trigger an RFE unless your employer can demonstrate through a detailed position description that the specific role requires that field's theoretical foundation.
How does the H-1B lottery affect my timeline as a Prompt Engineer?
USCIS runs a single annual registration window, typically in March, for the 85,000 cap-subject H-1B slots. Selection is random, so your employer registers your details and waits for the outcome. If selected, the petition window opens in April and approved status begins October 1. F-1 students on OPT may be eligible for a cap-gap extension if their OPT expires before that activation date.
Can I transfer my H-1B to a new employer if I switch Prompt Engineer jobs?
Yes. Under AC21 portability, you can start working for a new employer as soon as they file a new H-1B transfer petition, without waiting for approval, as long as your original petition was approved and you've been in valid H-1B status. The new employer must file a fresh LCA with DOL certifying the prevailing wage for your new role and location before USCIS accepts the transfer petition.
