Verify your RBT credential supports specialty occupation
USCIS requires H-1B roles to meet the specialty occupation standard. Pull the O*NET profile for RBTs and gather documentation showing your employer requires a bachelor's degree in psychology, education, or a related field, not just the RBT credential alone.
Target ABA employers enrolled in E-Verify
Employers who sponsor H-1B workers must participate in E-Verify. Filter your search to ABA clinics, autism service providers, and school-based therapy contractors with active E-Verify enrollment, as they've already cleared a key administrative hurdle for hiring nonimmigrant workers.
Search H-1B filing history on Migrate Mate
Use Migrate Mate to filter RBT and behavior technician roles by employers with verified H-1B LCA filing history. This surfaces providers who have sponsored the role before, not just companies that are theoretically open to it.
Request the LCA wage level before negotiating
Your employer files a Labor Condition Application certifying a wage at or above the DOL prevailing wage. Ask which wage level they intend to certify before you accept an offer. Level I covers entry roles; Level II or III better reflects supervised clinical experience.
Prepare supervised hours records early
When USCIS reviews an RBT H-1B petition, they may issue a Request for Evidence questioning specialty occupation. Collect signed supervision logs, BCBA oversight records, and your RBT Task List assessments now so your employer's attorney has them ready at filing.
Confirm cap timing with your employer's timeline
H-1B cap-subject petitions open in April for an October 1 start date. If you're finishing OPT or a grace period mid-year, confirm your prospective employer can submit by the April registration window or explore cap-exempt settings like university-affiliated research clinics.
H-1B Visa Registered Behavior Technician: Frequently Asked Questions
Does an RBT role qualify as an H-1B specialty occupation?
It depends on how the employer defines the position. USCIS requires that the role normally requires a bachelor's degree in a specific field. An RBT credential alone doesn't establish this. Employers need to document that they require a degree in psychology, applied behavior analysis, or a related field and that the duties reflect that requirement throughout the job description.
Which types of employers sponsor H-1B visas for RBT roles?
ABA therapy clinics, school districts, autism service organizations, and hospital-based behavioral health programs are the most common sponsors. University-affiliated programs are especially valuable because they're often cap-exempt, meaning they can file outside the April lottery window. Use Migrate Mate to identify employers with verified H-1B LCA filing history specifically for behavior technician roles.
Can I start an RBT job on OPT while waiting for H-1B approval?
Yes. If you're on post-completion OPT and your employer files an H-1B petition before your OPT expires, the cap-gap rule automatically extends your work authorization through September 30 of that year if you're selected. Your RBT credential and any active supervision logs should remain current throughout this period to avoid any gap in practice eligibility.
What does the DOL prevailing wage mean for RBT H-1B petitions?
Before filing your H-1B petition, your employer must certify with DOL that they'll pay you at or above the prevailing wage for RBT roles in your area. You can check what that wage is for your specific location using the OFLC Wage Search tool. The certified wage becomes a floor, not a ceiling, and is locked in on the Labor Condition Application your employer submits.
Does my BCBA supervisor need to be involved in the H-1B petition?
Not directly, but their documentation is important. If USCIS issues a Request for Evidence questioning specialty occupation, supervision records signed by your BCBA, treatment planning responsibilities you hold, and evidence of degree-level skill requirements can all strengthen the response. Your employer's immigration attorney will typically ask for these materials during petition preparation.
