H-1B Visa Registered Nurse Med Surg Jobs
Registered Nurse Med Surg roles qualify as H-1B visa specialty occupations when the position requires a BSN or higher. U.S. hospitals sponsor H-1B nurses through USCIS, but NCLEX licensure, state-specific credentials, and CGFNS evaluations must align before your employer can file the Labor Condition Application.

Get your CGFNS credential evaluation early
Foreign-educated nurses need a CGFNS VisaScreen certificate or equivalent credential evaluation before most hospitals will file an H-1B petition. Start this process six to twelve months before your target start date to avoid delays.
Verify your state nursing license transfers
H-1B approval doesn't guarantee you can practice in every state. Confirm your RN license is valid or transferable in the state where the employer is located before the LCA is filed with DOL.
Target hospitals enrolled in E-Verify
STEM OPT employers must use E-Verify, but for H-1B nurses, E-Verify enrollment signals the employer has an established foreign-worker hiring process. Use Migrate Mate to filter Med Surg roles by employers with verified H-1B LCA filing history.
Understand how prevailing wage affects your offer
Your employer must pay the DOL prevailing wage for your SOC code and location. Check the OFLC Wage Search before negotiating your offer so you know the minimum the LCA must certify for your county and experience level.
Ask about cap-exempt hospital systems
Nonprofit hospitals affiliated with universities or research institutions may qualify as cap-exempt H-1B employers, meaning they can file year-round without waiting for the April lottery. Confirm 501(c)(3) status and cap-exempt eligibility directly with the recruiter.
Align your start date with the H-1B cap timeline
Cap-subject H-1B petitions have an October 1 start date. If your NCLEX results or credential evaluation aren't finalized before the March registration window, you'll miss the cycle and wait a full year for the next lottery.
H-1B Visa Registered Nurse Med Surg: Frequently Asked Questions
Does a Registered Nurse Med Surg role qualify as an H-1B specialty occupation?
Yes, when the employer's job description requires a minimum of a BSN for the position. USCIS evaluates specialty occupation status based on the role requirements, not just the industry. Some hospitals list a BSN as preferred rather than required, which can create an RFE risk. Before accepting an offer, confirm the job posting explicitly states a bachelor's degree in nursing as the minimum requirement.
How do I find Med Surg nursing employers who actively sponsor H-1B visas?
Search Migrate Mate for Registered Nurse Med Surg roles filtered by employers with documented H-1B LCA filing history. Hospitals with consistent filing records have established immigration processes, legal infrastructure, and HR teams familiar with the petition requirements, which reduces delays on the employer side after you receive your offer.
What credentials do I need before an employer can file my H-1B petition?
You need an active RN license in the state where the job is located, a passing NCLEX score, and a credential evaluation from CGFNS or an equivalent body if you trained outside the U.S. Most hospitals also require the VisaScreen certificate before initiating the LCA filing with DOL. Missing any of these will stall the petition regardless of employer readiness.
Can I switch Med Surg nursing jobs while on H-1B status?
Yes, using H-1B portability under AC21. If your new employer files an H-1B transfer petition while your current petition has been pending or approved for more than 180 days, you can start the new role without waiting for approval. The new position must remain in a specialty occupation nursing role at a comparable wage level to qualify for portability.
What is the LCA requirement for Med Surg nursing jobs and how does it affect my offer?
Before filing your H-1B petition, your employer must obtain a certified Labor Condition Application from DOL. The LCA locks in the wage level and work location, meaning your offered salary must meet or exceed the DOL prevailing wage for your SOC code and county. Use the OFLC Wage Search to check the wage level before your offer is finalized so there are no surprises during filing.
