Verify your credentials meet state licensure before applying
Most H-1B petitions for Respiratory Therapists require state RRT licensure or eligibility. Confirm your NBRC credentials transfer to your target state before your employer files the LCA, since licensure gaps can delay or derail the petition.
Search LCA data to identify proven sponsors
Use Migrate Mate to filter employers by verified H-1B LCA filings for Respiratory Therapist roles. This shows you which health systems have actually sponsored the position, not just those open to the idea.
Target large hospital systems over small outpatient clinics
Large health systems have dedicated HR and immigration counsel experienced in H-1B filing. Smaller outpatient clinics often lack the infrastructure to complete an LCA filing and may withdraw offers mid-process when costs become clear.
Confirm your role qualifies under O*NET specialty occupation standards
USCIS adjudicators assess whether the position requires a specialized bachelor's degree. Review the O*NET profile for Respiratory Therapists to confirm your job duties align with the documented education requirements before your employer files Form I-129.
Request premium processing if your start date is fixed
If your employer sets a hard start date tied to a hospital onboarding cycle, ask them to file with USCIS premium processing. Standard H-1B adjudication can take several months, and clinical onboarding schedules rarely accommodate that window.
Clarify prevailing wage level before accepting an offer
Your employer must certify your wage meets the DOL prevailing wage for your role and location on the LCA. Use the OFLC Wage Search to check the Level I through Level IV wage tiers for Respiratory Therapists in your target metro before negotiating your offer.
H-1B Visa Respiratory Therapist: Frequently Asked Questions
Does a Respiratory Therapist role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS recognizes Respiratory Therapist as a specialty occupation because the role normally requires at least a bachelor's degree in respiratory care or a directly related clinical science field. Your employer must document this requirement in the H-1B petition. Associate degree holders who don't meet this threshold may face an RFE questioning specialty occupation status.
Which employers are most likely to sponsor H-1B visas for Respiratory Therapists?
Large hospital systems, academic medical centers, and VA facilities are the most consistent sponsors because they have immigration infrastructure in place and predictable hiring cycles. Smaller outpatient or home health employers sponsor less frequently. You can identify employers with verified H-1B filing history for this specific role through Migrate Mate, which surfaces DOL LCA data by occupation.
How does the H-1B cap lottery affect Respiratory Therapist job seekers?
Most hospital and health system positions fall under the standard H-1B cap, so you must be selected in the annual lottery to receive an H-1B. Roles at nonprofit hospitals affiliated with universities or research institutions may qualify for cap-exempt status, which allows filing at any time without lottery registration. Confirm your employer's cap-exempt eligibility before the March registration window closes.
Can I work as a Respiratory Therapist on OPT or STEM OPT while waiting for H-1B approval?
You can work on OPT or STEM OPT if you graduated from a U.S. program in a qualifying field such as respiratory therapy or a related health science. However, Respiratory Therapy is not classified under a STEM-designated CIP code, so you're unlikely to qualify for the 24-month STEM OPT extension. Standard OPT provides 12 months, so timing your H-1B registration carefully is essential.
What documents should I prepare before an employer starts the H-1B filing process?
Gather your NBRC credential certificates, state RRT license, academic transcripts showing your degree in respiratory care or a related field, and a copy of your current immigration status documents including your I-94 record. Your employer's immigration attorney will need these to complete the prevailing wage determination with DOL and prepare the Form I-129 petition for USCIS.
