Match your degree to the role
USCIS requires your degree field to directly relate to the Safety Specialist position. A degree in occupational health, industrial hygiene, environmental science, or safety engineering typically satisfies this. A general business or unrelated STEM degree may trigger an RFE.
Verify your SOC code before applying
Safety Specialists file under SOC 29-9021 (Occupational Health and Safety Specialists). Confirm your prospective employer's LCA lists this code. A mismatched SOC code can misclassify the role and undermine the specialty occupation argument at adjudication.
Search LCA-verified employers on Migrate Mate
Filter Safety Specialist roles by employers with active H-1B LCA filing history on Migrate Mate. This surfaces companies that have already cleared DOL's wage certification step, reducing the risk of pursuing employers who've never sponsored the role.
Check prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for your location and experience level. Use the OFLC Wage Search to look up the Level I through Level IV wage for SOC 29-9021 in the metro area where you'll work before accepting any offer.
Target industries with consistent H-1B filing history
Chemical manufacturing, utilities, aerospace, and large construction firms sponsor Safety Specialists more regularly than small contractors. OFLC disclosure data shows which industries certify LCAs for this occupation code, helping you prioritize employers already familiar with the process.
Confirm cap-gap coverage if you're on OPT
If your employer files your H-1B petition before your OPT expires and you're selected in the lottery, cap-gap automatically extends your work authorization through September 30. USCIS issues a cap-gap receipt notice your employer should retain for E-Verify compliance.
H-1B Visa Safety Specialist: Frequently Asked Questions
Does a Safety Specialist role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires a bachelor's degree or higher in a specific related field such as occupational health, safety science, industrial hygiene, or environmental engineering. USCIS evaluates each petition individually. Roles that accept any degree field, or that only require certifications like CSP or OSHA 30, face a higher risk of an RFE challenging specialty occupation status.
Which employers sponsor H-1B visas for Safety Specialist positions?
Employers in chemical manufacturing, oil and gas, aerospace, utilities, and large construction firms regularly sponsor Safety Specialists and have established LCA filing histories with DOL. You can find Safety Specialist roles at H-1B-sponsoring employers on Migrate Mate, which filters listings by verified LCA filing activity so you're targeting companies already familiar with the sponsorship process.
How does the prevailing wage requirement affect a Safety Specialist H-1B offer?
Your employer must certify through DOL that your offered salary meets or exceeds the prevailing wage for SOC 29-9021 in your work location before USCIS will approve the petition. Wages are tiered from Level I to Level IV based on experience and job complexity. Use the OFLC Wage Search to verify the applicable wage for your metro area before finalizing your offer letter.
Can a Safety Specialist transfer H-1B status to a new employer mid-authorization?
Yes. Under AC21 portability, you can begin working for a new employer as soon as they file an H-1B transfer petition with USCIS, provided your current H-1B has been approved and you're maintaining valid status. The new employer must file a fresh I-129 and obtain LCA certification for your new work location and wage level before you start.
What O*NET classification applies to Safety Specialist roles, and why does it matter for H-1B petitions?
Safety Specialists typically fall under O*NET code 29-9021, classified as a Job Zone 4 occupation requiring substantial preparation and a relevant bachelor's degree. USCIS references O*NET when evaluating whether a role constitutes a specialty occupation. If your employer's job description maps to a lower job zone on O*NET, it weakens the specialty occupation argument and increases RFE risk.
