Verify your degree supports specialty occupation
USCIS requires a direct connection between your degree field and the sales role. A marketing or business degree supports most B2B sales positions, but a general studies degree may trigger an RFE. Pull the O*NET profile for Sales Representative to document the degree requirement before applying.
Target employers with LCA filing history
Search Migrate Mate to filter Sales Representative openings by employers who have previously filed H-1B LCAs. Companies with a track record of sponsoring this specific SOC code are far more likely to have an established process and legal support already in place.
Prioritize cap-exempt or high-volume sponsors
Universities, nonprofits, and government research entities are cap-exempt, meaning your petition skips the lottery entirely. For-profit employers entering the lottery must file in March for an October start, so time your offer negotiations to align with that cycle.
Confirm the prevailing wage tier before negotiating
Your employer must pay at least the DOL prevailing wage for your role, location, and experience level. Run your title and ZIP code through the OFLC Wage Search before discussing compensation so you know the Level I through Level IV floor and can negotiate above it confidently.
Ask employers about their LCA filing timeline
The LCA must be certified by DOL before USCIS can receive your I-129 petition. Ask your hiring manager whether they use in-house counsel or outside immigration attorneys, and what their typical LCA-to-petition timeline looks like. Delays here directly push back your start date.
Document commission structures for wage compliance
If your compensation includes variable commissions, USCIS scrutinizes whether the base salary alone meets the prevailing wage. Get the commission plan in writing and confirm the base exceeds the DOL threshold so your employer's LCA certification isn't challenged during adjudication.
H-1B Visa Sales Representative: Frequently Asked Questions
Does a Sales Representative role qualify as an H-1B specialty occupation?
It depends on how the role is defined. USCIS requires that the position normally requires at least a bachelor's degree in a specific related field. A sales role tied to technical products, enterprise software, pharmaceuticals, or financial services typically qualifies. A general retail or inside sales role without a degree requirement usually does not. The employer's job description and the SOC code they use on the LCA both matter.
Which industries sponsor H-1B visas for Sales Representative roles most often?
Technology, pharmaceutical, financial services, and medical device companies sponsor H-1B Sales Representatives most frequently because their products require specialized knowledge that aligns with a degree requirement. Enterprise software firms in particular file LCAs for sales roles at scale. You can browse Sales Representative openings filtered by H-1B filing history on Migrate Mate to identify which employers in your target industry have an active sponsorship track record.
Can my employer count variable commission toward the H-1B prevailing wage?
Not reliably. DOL prevailing wage compliance is measured against guaranteed, non-contingent compensation. Commission income can fluctuate and is generally not counted toward the required wage floor. Your base salary must meet or exceed the prevailing wage for your role, location, and experience level as determined by the OFLC Wage Search. If your base alone falls short, the LCA certification may be denied or later challenged.
What happens to my H-1B status if I change sales territories or move to a new office location?
A move to a new worksite location, even within the same employer, typically requires a new or amended LCA certified for that specific metropolitan statistical area. If the prevailing wage is higher at the new location, your employer must pay the higher rate. USCIS requires an amended I-129 petition if the move constitutes a material change in the terms of your employment. Notify your employer's immigration counsel before any relocation.
How do I find Sales Representative roles where the employer already understands H-1B sponsorship?
Target employers who have filed H-1B LCAs for Sales Representative positions in prior years. These companies have existing relationships with immigration attorneys and internal processes for handling petitions. Avoid roles at companies that have never sponsored before, as the learning curve can add months to your start date. Migrate Mate surfaces Sales Representative openings filtered specifically for employers with verified H-1B filing history, so you can focus your search where sponsorship is already established.
