Build a portfolio that documents specialty occupation
USCIS requires Marketing Designer roles to demonstrate a direct link between your degree field and the job duties. Organize your portfolio to show projects where your design decisions required specialized academic knowledge, not just aesthetic judgment.
Use OFLC Wage Search before salary negotiations
Your employer's LCA must certify a wage at or above the prevailing wage for your SOC code and work location. Run the OFLC Wage Search before accepting an offer so you know the DOL threshold your employer is legally required to meet.
Target employers with active LCA filing history
Search Migrate Mate to filter Marketing Designer roles by employers who have filed LCAs for this occupation code. Past filings signal that an employer already understands the H-1B process and won't stall on sponsorship paperwork.
Clarify job title framing with your hiring manager
Titles like 'Creative Associate' or 'Brand Specialist' can complicate specialty occupation arguments. Before your offer letter is drafted, confirm that the official title and job description clearly reflect design duties requiring a relevant bachelor's degree.
Time your application around the cap registration window
H-1B cap registration opens in March each year for an October 1 start date. If you're on OPT, confirm your OPT end date aligns with this timeline so your employer can file promptly after selection.
Check O*NET to support your specialty occupation case
The O*NET occupation profile for Marketing Designers documents the education and knowledge requirements USCIS reviewers reference. Share the O*NET entry with your employer's HR or legal team to help them build a stronger I-129 petition.
H-1B Visa Marketing Designer: Frequently Asked Questions
Does a Marketing Designer role qualify as a specialty occupation for H-1B purposes?
Yes, as long as the position normally requires a bachelor's degree or higher in a specific field such as graphic design, marketing, or visual communications. Roles where any general degree is accepted, or where the employer does not require a degree at all, are harder to defend as specialty occupations. Your employer should document the degree requirement explicitly in the job description and LCA.
Which types of employers sponsor H-1B visas for Marketing Designers?
Tech companies, e-commerce brands, media agencies, and large consumer goods firms file the most H-1B petitions for design and marketing roles because their in-house teams require consistent, specialized output at scale. Smaller agencies may be willing but less experienced with the filing process. You can browse verified H-1B sponsoring employers for Marketing Designer roles on Migrate Mate.
Can my employer start sponsoring me before my OPT expires?
Yes, and timing matters. Your employer must file the I-129 petition after H-1B cap selection and before your OPT authorization lapses. If your OPT ends before October 1, the cap-gap rule extends your work authorization automatically, provided your employer filed a timely petition after you were selected in the lottery.
How does the prevailing wage requirement affect Marketing Designer job offers?
The DOL requires your employer to pay at least the prevailing wage for your role's SOC code and work location, as certified in the LCA. Prevailing wages vary significantly by metro area, so a position in San Francisco carries a higher wage floor than the same role in a smaller market. Use the OFLC Wage Search to verify the applicable wage level before you evaluate an offer.
What happens to my H-1B if I change jobs or employers?
H-1B status is tied to the sponsoring employer. If you change jobs, your new employer must file an H-1B transfer petition before you start work. You can begin working for the new employer as soon as the transfer petition is filed and a receipt notice is issued, without waiting for full approval, under H-1B portability rules. Changing to a role outside marketing or design may require a new specialty occupation determination.
