Validate your specialty occupation documentation early
USCIS scrutinizes IT Architect roles for specialty occupation eligibility. Pull the O*NET profile for your SOC code and document how your degree field maps directly to enterprise architecture, infrastructure design, or systems integration, not general IT management.
Search LCA filing history by occupation code
Use Migrate Mate to filter employers who have filed LCAs under the computer systems architect SOC codes. This surfaces companies with active H-1B sponsorship history for your specific role, not just general tech employers.
Target employers with cap-exempt petition pathways
Universities, nonprofit research institutions, and government-affiliated entities can file H-1B petitions year-round outside the annual cap lottery. Senior IT Architects at these organizations skip the April registration window entirely.
Request the prevailing wage tier before negotiating
Run your job title, SOC code, and work location through the OFLC Wage Search before accepting an offer. Knowing your Level III or Level IV prevailing wage gives you a floor for salary negotiations and confirms the employer's LCA will clear DOL certification.
Clarify project-site work arrangements before the I-129 files
If your role involves client-site deployments or multi-location work, the employer must file an amended I-129 or obtain additional LCA certifications for each worksite. Confirm this scope with your employer's immigration counsel before the original petition is submitted to USCIS.
Use the 60-day grace period strategically between roles
If your H-1B employment ends, you have a 60-day grace period to secure a new offer and have a transfer petition filed. Prioritize employers who can file concurrently with the I-129 so your work authorization continues without interruption under portability rules.
H-1B Visa Senior IT Architect: Frequently Asked Questions
Does a Senior IT Architect role qualify as an H-1B specialty occupation?
Yes, Senior IT Architect qualifies as a specialty occupation when the position requires at least a bachelor's degree in computer science, information systems, software engineering, or a closely related field. USCIS evaluates each petition individually, so your employer's job description must specify the degree requirement clearly. Roles framed as general management without a specific technical degree requirement can attract a Request for Evidence.
What SOC code do employers typically use for H-1B filings for this role?
Most employers file under SOC 15-1299 (Computer Occupations, All Other) or 15-1244 (Network and Computer Systems Administrators), though enterprise architects may also fall under 15-1211 (Computer Systems Analysts). The SOC code determines the prevailing wage tier on the Labor Condition Application, so a mismatch between your actual duties and the code filed can create compliance issues. Confirm the code with your employer before the LCA is submitted to DOL.
How do I find employers actively sponsoring H-1B visas for Senior IT Architect positions?
Search Migrate Mate to identify employers with verified LCA filing history under computer systems and architecture occupation codes. This shows you which companies have sponsored this specific role type, not just general H-1B sponsors. Prioritizing employers with a documented track record in your specialty reduces the risk of navigating the process with a first-time sponsor unfamiliar with the requirements.
Can I transfer my H-1B to a new employer if I receive a better Senior IT Architect offer?
Yes, H-1B portability allows you to start working for a new employer as soon as the transfer petition is filed with USCIS, without waiting for approval. Your new employer must file a new I-129 and LCA before you begin. If your current H-1B has been approved for at least 180 days, your status is protected even if the transfer petition receives a Request for Evidence.
Does a multi-site or client-facing Senior IT Architect role create additional H-1B compliance requirements?
Yes. If your role requires regular work at client locations or multiple employer sites, your sponsoring employer must obtain a certified LCA for each worksite metropolitan area and post the LCA notice at each location. Failing to maintain site-specific LCAs is one of the most common H-1B compliance violations in consulting and professional services engagements. Clarify the worksite obligations with your employer's immigration team before your I-129 is filed.
