Verify your degree meets specialty occupation standards
USCIS requires a direct relationship between your degree field and the senior engineering role. A computer science or software engineering degree clears this cleanly; an unrelated degree paired with years of experience often triggers an RFE, so gather transcripts and credential evaluations early.
Check prevailing wages before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your SOC code and work location. Use the OFLC Wage Search to find the Level III or Level IV wage for senior roles in your metro before your offer conversation.
Filter employers by verified H-1B filing history on Migrate Mate
Not every company that posts senior engineering roles has an active H-1B program. Migrate Mate surfaces employers with confirmed LCA filing history so you focus your applications on companies that have already gone through the sponsorship process.
Target cap-exempt organizations to skip the lottery
Universities, nonprofit research institutions, and certain government research organizations are cap-exempt, meaning your employer can file an H-1B petition any time of year with no lottery exposure. Senior engineering roles at these institutions follow the same technical requirements but eliminate lottery timing risk entirely.
Request premium processing when your start date is firm
USCIS premium processing guarantees a decision within 15 business days. For senior engineering roles with a negotiated start date tied to a product launch or team onboarding cycle, premium processing prevents the ambiguity of standard timelines from colliding with your employer's planning.
Document your senior-level scope clearly in the job description
USCIS scrutinizes whether a role genuinely requires a degree rather than just preferring one. Your employer's job description and LCA should detail system architecture ownership, technical leadership responsibilities, and complexity that distinguishes the role from a mid-level position.
H-1B Visa Senior Software Engineering: Frequently Asked Questions
Do Senior Software Engineering roles qualify as H-1B specialty occupations?
Yes. Senior Software Engineering positions qualify because they require at least a bachelor's degree in a specific technical field such as computer science, software engineering, or electrical engineering. USCIS evaluates the actual duties, not just the title, so the job description must reflect work that inherently requires that degree-level knowledge. Roles involving system design, architecture decisions, and cross-functional technical leadership typically satisfy this standard without issue.
How do I find employers actively sponsoring H-1B visas for software engineering roles?
Migrate Mate lists Senior Software Engineering jobs filtered by employers with documented H-1B LCA filing history, so you can skip companies that have never sponsored and focus on those with an active track record. DOL LCA disclosure data is publicly available and updated quarterly, and Migrate Mate surfaces that data directly alongside job listings so you're not guessing about a company's sponsorship posture.
What happens to my H-1B if I get promoted or change teams after sponsorship?
A promotion to a materially different role, such as moving from individual contributor to engineering manager with different primary duties, may require an amended H-1B petition. A lateral team change with the same job duties and title typically does not. Your employer's immigration counsel should evaluate whether the new role's SOC code or duties differ enough from the original LCA to trigger an amendment, because filing after the fact creates compliance risk.
Can my employer file my H-1B at a lower wage level if I'm mid-career?
Your employer must pay at least the DOL prevailing wage for the specific SOC code and work location, but they can choose any wage level from Level I through Level IV that accurately reflects your experience and responsibilities. For senior roles, USCIS and DOL both expect Level III or Level IV wages. Filing a senior position at Level I can draw scrutiny from both agencies and should be avoided regardless of what the offer letter says.
Does working remotely affect my H-1B if my employer is in a different city?
Yes. Your H-1B and LCA are tied to a specific work location. If you work remotely from a different metro area than the one listed on the LCA, your employer generally needs to file a new LCA covering that worksite and potentially an amended H-1B petition. Short-term travel and temporary assignments follow different rules, but permanent or long-term remote arrangements in a different location require updated filings to stay compliant.
