Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to the role. A computer science or engineering degree maps cleanly to Software Engineering Manager. An unrelated degree needs documented coursework or progressive experience to bridge the gap.
Check LCA wage levels before accepting offers
Your employer's LCA must certify a wage at Level II or higher for a management role. Run the job title through OFLC Wage Search by location to confirm the certified wage matches what you've been offered before signing anything.
Target companies with active H-1B filing history
Use Migrate Mate to filter Software Engineering Manager roles by employers with verified LCA filing history, so you're applying to companies that have actively sponsored this specific job title, not just tech employers in general.
Negotiate cap-exempt employment as a backup path
If you miss the H-1B lottery, roles at universities, nonprofit research organizations, and government research entities are cap-exempt. Some engineering managers at these institutions can start immediately without waiting for the October 1 start date.
Request concurrent H-1B filing during employer transitions
Switching from an IC role to a management title at a new company requires a new H-1B petition. Filing portability under AC21 only applies after 180 days of approved status, so time your transition to avoid gaps in work authorization.
Align your O*NET occupation code with the LCA
Software Engineering Manager maps to a specific SOC code in O*NET that determines prevailing wage tier. Confirm your employer's LCA uses the correct code for your actual duties. A mismatch between the filed occupation and your offer letter scope can trigger an RFE.
H-1B Visa Software Engineering Manager: Frequently Asked Questions
Does a Software Engineering Manager role qualify as an H-1B specialty occupation?
Yes. USCIS treats Software Engineering Manager as a specialty occupation because the role normally requires at least a bachelor's degree in computer science, software engineering, or a closely related field. The degree must correspond directly to the job duties. If your degree is in an unrelated field, your employer's attorney will need to document how your coursework or progressive technical experience supports the specialty occupation determination.
Which employers typically sponsor H-1B visas for Software Engineering Manager positions?
Mid-size and large tech companies, enterprise software firms, financial institutions with engineering teams, and cloud infrastructure providers are the most active sponsors for this title. Companies that already employ H-1B engineers frequently sponsor management promotions internally. Migrate Mate shows employers with verified LCA filing history for this specific role, which is a more reliable signal than general company reputation for sponsorship.
Can I get promoted from a senior engineer to a Software Engineering Manager role while on H-1B?
Yes, but your employer must file an amended H-1B petition with USCIS before or when the role change takes effect. A title change to a management function with different job duties and a new SOC code is a material change that requires amendment. You can continue working during the amendment, but your employer needs to file promptly to stay compliant.
What happens to my H-1B if my employer does a layoff while I'm in a Software Engineering Manager role?
You have a 60-day grace period after your last day of employment to find a new sponsor, change status, or depart the U.S. During this window, a new employer can file an H-1B transfer petition, allowing you to start working once USCIS receives the filing. Senior engineering manager roles can also qualify for O-1A consideration if you have documented team leadership, publications, or awards that meet extraordinary ability criteria.
How does the H-1B prevailing wage requirement affect Software Engineering Manager job offers?
Your employer must file an LCA certifying that your wage meets at least the prevailing wage for the Software Engineering Manager SOC code in your work location. Management roles typically fall at wage Level II or III in the DOL's four-tier system. You can verify the required wage for any metro area using the OFLC Wage Search before evaluating an offer, which helps you assess whether a company's compensation is compliant before accepting.
