Map your credentials to specialty occupation
USCIS evaluates Technical Director roles under the specialty occupation standard. Pull the O*NET profile for your specific TD function, whether film, engineering, or technology, and align your degree and experience to its listed education requirements before applying.
Target employers with cap-exempt affiliations
Universities, nonprofit research organizations, and government-related entities can file H-1B petitions outside the annual lottery. Technical Director roles at these institutions let you start immediately rather than waiting for an October 1 cap-subject start date.
Verify the prevailing wage before negotiating
Your employer must pay the DOL-certified prevailing wage for your location and job title. Run an OFLC Wage Search using the SOC code for your TD function before salary discussions so you know the minimum the LCA must certify.
Find H-1B-filing employers on Migrate Mate
Search Technical Director roles on Migrate Mate to filter for employers with verified H-1B LCA filing history. This shows you which companies have filed for comparable roles, so you're not guessing about sponsorship willingness before you apply.
Clarify who owns the I-129 filing timeline
Technical Director hires often involve extended negotiations and counteroffers. Confirm with HR exactly when they'll file the I-129 petition and whether they'll use premium processing, since USCIS's 15-business-day premium window determines how quickly you can start.
Document your leadership scope for RFE defense
USCIS sometimes challenges Technical Director petitions when the role involves both creative oversight and hands-on execution. Your offer letter and organizational chart should explicitly show the degree-specific knowledge the position requires, not just seniority.
H-1B Visa Technical Director: Frequently Asked Questions
Does a Technical Director role qualify as an H-1B specialty occupation?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as computer science, engineering, film production, or a related discipline. USCIS looks at whether the role's duties are complex enough to require that specific theoretical and practical knowledge. A generalist TD role without a defined degree requirement is harder to support than one tied to a specific technical domain.
How do I find employers who sponsor H-1B visas for Technical Director positions?
Migrate Mate filters Technical Director listings by employers with verified H-1B LCA filing history, so you can focus on companies that have sponsored comparable roles rather than those that may be open to it in principle. This saves time during a search where sponsorship willingness is the first filter.
Can I transfer my H-1B to a new Technical Director role without losing status?
Yes. Under H-1B portability, you can start working for a new employer once they file your transfer petition, as long as your previous H-1B was approved, you've been in status, and the new TD role also qualifies as a specialty occupation. The new employer still needs to file an LCA and I-129 for the specific position.
What happens if USCIS issues an RFE on my Technical Director petition?
A Request for Evidence on a Technical Director petition typically challenges whether the role requires a specific bachelor's degree or disputes whether your degree matches the position. Your employer's immigration counsel should respond with documentation showing the job's theoretical complexity, your degree's direct relevance, and industry norms supporting the degree requirement for that TD function. Response deadlines are strict, so flag it immediately.
Does the SOC code my employer uses on the LCA affect my H-1B petition outcome?
Yes. The Standard Occupational Classification code determines the DOL prevailing wage level your employer must certify and signals to USCIS what kind of role is being filed. Technical Directors can fall under multiple SOC codes depending on the industry. If the code doesn't match your actual duties, USCIS may issue an RFE or deny the petition, so confirm the SOC selection with your employer before the LCA is filed.
