Verify your credential equivalency early
If you trained outside the U.S., get your foreign degree evaluated by a NACES-member credential evaluator before applying. USCIS scrutinizes specialty occupation claims for therapist roles when the degree field doesn't directly match the clinical position.
Target employers with active LCA filing history
Use Migrate Mate to filter therapist roles by employers who have filed Labor Condition Applications for clinical and mental health positions, so you're applying where H-1B sponsorship is already part of the hiring process.
Understand how the prevailing wage affects your offer
Your employer's LCA must certify your offered salary meets the DOL prevailing wage for your specific therapist occupation code and work location. Run your job title and county through the OFLC Wage Search to verify your offer qualifies before signing.
Ask about cap-exempt employer eligibility
Nonprofit hospitals, university-affiliated counseling centers, and government-funded community mental health organizations may qualify as cap-exempt H-1B employers. A cap-exempt filing bypasses the lottery entirely and can be submitted any time of year.
Align your licensure renewal with your H-1B validity dates
H-1B status for therapists is tied to continued employment in a licensed clinical role. If your state license lapses mid-petition period, your employer's ability to maintain the H-1B may be affected, so build renewal deadlines into your calendar proactively.

Find Therapist JobsTherapist H-1B Visa: Frequently Asked Questions
Does a therapist role qualify as a specialty occupation for H-1B purposes?
Yes, therapist positions generally qualify as specialty occupations when the role requires at minimum a bachelor's degree in psychology, counseling, social work, or a directly related clinical discipline. USCIS evaluates whether the degree requirement is standard for the position in the industry. Roles with vague degree requirements or that accept any bachelor's field face higher rates of Requests for Evidence, so a precise job description matters.
Which types of employers sponsor H-1B visas for therapists?
Hospital systems, inpatient behavioral health facilities, community mental health centers, telehealth companies, and university counseling departments are the most active H-1B sponsors for therapist roles. Nonprofit and government-affiliated organizations in this space often qualify as cap-exempt employers, meaning they can file outside the annual lottery window. Browse Migrate Mate to find therapist openings filtered by employers with verified LCA filing history.
Can I work as a therapist on H-1B while completing supervised licensure hours?
Yes, but your employer's H-1B petition must describe your role in terms that match the supervised position, and you must be paid the DOL prevailing wage for that occupation level and location. Some states issue a provisional or associate license that permits supervised practice, which USCIS may accept as meeting the licensure condition. Confirm your state's provisional license category is recognized before your employer files.
How does the H-1B cap lottery affect therapists applying through for-profit employers?
For-profit hospitals, private practice groups, and commercial telehealth companies are subject to the annual H-1B cap and lottery. USCIS typically opens registration in March for an October 1 start date, so your job offer and employer filing commitment must be in place before the registration window. If you aren't selected, you remain in your current status until the next lottery cycle unless your employer qualifies for a cap-exempt filing.
What occupation codes does USCIS and DOL use for therapist H-1B petitions?
DOL and USCIS classify therapists under several Standard Occupational Classification codes depending on the clinical specialty, including categories for mental health counselors, marriage and family therapists, substance abuse counselors, and clinical social workers. Each code carries its own prevailing wage tier by location. Check O*NET for the job zone and degree requirements associated with your specific title, and use the OFLC Wage Search to confirm the wage level your employer must certify.
