Verify your credential equivalency early
A three-year nursing or health sciences degree from outside the U.S. may need a credential evaluation before USCIS accepts it as equivalent to a U.S. bachelor's degree. Get a NACES-member evaluation done before you start applying.
Search LCA filings by occupation code
Filter DOL disclosure data using the SOC code for Nursing Attendants to see which employers have active LCA certifications for this exact role. Use Migrate Mate to surface that filing history without downloading raw OFLC files.
Target employers enrolled in E-Verify
STEM OPT and cap-gap protections require E-Verify enrollment. For Nursing Attendants, prioritize hospital networks and long-term care operators already enrolled, since they've built compliance infrastructure for sponsored workers.
Confirm the role meets specialty occupation standards
Not every Nursing Attendant posting qualifies as a specialty occupation under USCIS rules. Look for job descriptions that explicitly require a bachelor's degree in nursing, health sciences, or a directly related field, not just preferred qualifications.
Ask about prevailing wage level before signing
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your role and location. Run your job title and metro area through the OFLC Wage Search to know what Level I through Level IV wages look like before you negotiate.
Time your filing around the cap and premium processing
H-1B cap registration opens in March for an October 1 start date. If your employer offers premium processing on Form I-129, USCIS adjudicates within 15 business days, which reduces uncertainty while you're transitioning between OPT and H-1B status.

Find Nursing Attendant JobsNursing Attendant H-1B Visa: Frequently Asked Questions
Does a Nursing Attendant role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires that the role normally demands a bachelor's degree in a specific, directly related field. If the job description lists a degree as preferred rather than required, or accepts any health-related degree, USCIS may issue an RFE challenging specialty occupation status. Roles at hospitals or skilled nursing facilities that explicitly require a degree in nursing or health sciences are stronger candidates.
Which types of employers sponsor H-1B visas for Nursing Attendant positions?
Large hospital systems, academic medical centers, and multi-facility long-term care operators are the most consistent H-1B filers for direct-care roles. These employers have in-house immigration counsel and established LCA filing processes. Smaller outpatient clinics or private practices rarely sponsor because the compliance overhead is harder to absorb. You can browse verified filing history by employer on Migrate Mate to identify who has filed for this specific role.
Will my foreign nursing credential be accepted for H-1B sponsorship?
USCIS evaluates foreign degrees for equivalency to a U.S. bachelor's degree. A three-year nursing diploma from certain countries may qualify, but you'll need a credential evaluation from a NACES-member organization to document that equivalency in the petition. Some countries' two-year programs do not meet the threshold, so get the evaluation done before your employer files Form I-129.
What O*NET information is relevant for a Nursing Attendant H-1B petition?
O*NET classifies Nursing Attendants under SOC code 31-1131, with a Job Zone of 2, which typically indicates minimal formal education requirements. This can create friction in H-1B petitions because USCIS may cite the O*NET profile as evidence the role doesn't require a bachelor's degree. Your employer's attorney will need to distinguish the specific position from the general O*NET classification using the actual job duties and internal degree requirements.
How does the prevailing wage requirement apply to Nursing Attendant H-1B roles?
Before filing the H-1B petition, your employer must certify an LCA with DOL confirming your wage meets or exceeds the prevailing wage for Nursing Attendants in your specific metro area. Prevailing wages vary significantly by geography. You can check the applicable wage levels using the OFLC Wage Search, filtering by occupation and location, to understand where your offered compensation sits relative to the four wage levels DOL uses.
