Verify your role meets specialty occupation
Pull the O*NET profile for Sales Managers (SOC 11-2022) and confirm your job duties align with the listed requirements. USCIS scrutinizes VP-level roles where a specific degree field isn't obvious, so document how your employer ties the position to a defined discipline.
Target employers with LCA filing history
Use Migrate Mate to filter Vice President of Sales openings by employers who have certified LCAs in sales leadership roles. Verified filing history tells you the employer already understands the H-1B process rather than treating your petition as a first attempt.
Check the prevailing wage before negotiating
Run your job title and work location through the OFLC Wage Search before your offer conversation. Your employer's LCA must certify a wage at or above the Level III or IV threshold for your metro, and a salary below that cannot be approved regardless of negotiation.
Prepare an executive-level credentials package
Gather degree transcripts, professional certifications, and documentation of revenue responsibility or team leadership. USCIS RFEs for senior sales roles often challenge whether the position genuinely requires a specialized degree, so concrete P&L ownership and organizational scope records counter that directly.
Confirm E-Verify enrollment before accepting an offer
Ask whether the employer is enrolled in E-Verify before the offer stage, not after. If you're on STEM OPT, E-Verify enrollment is legally required for your employer. For H-1B transitions, unenrolled employers can still file, but knowing early prevents last-minute complications.
Plan for the October 1 start date gap
Cap-subject H-1B approvals take effect October 1, so a March registration win still leaves a potential six-month gap. If you're changing employers, map whether your current authorization covers that window or whether a cap-exempt employer removes the timing constraint entirely.
H-1B Visa Vice President Of Sales: Frequently Asked Questions
Does a Vice President of Sales job qualify for H-1B sponsorship?
Yes, provided the employer can demonstrate the role requires a bachelor's degree or higher in a specific field such as business administration, marketing, or sales management. VP-level roles with generalist duties can face USCIS scrutiny, so the job description should clearly connect the position's responsibilities to a defined academic discipline rather than accepting any degree.
Which employers sponsor H-1B visas for senior sales leadership roles?
Enterprise technology companies, financial services firms, and multinational corporations are among the most consistent H-1B sponsors for VP of Sales positions because they have established immigration infrastructure and experience with senior-level petitions. Migrate Mate lets you search Vice President of Sales openings filtered by employers with verified LCA filing history, so you're only targeting companies that have already navigated this process.
What is the H-1B prevailing wage requirement for a VP of Sales?
Your employer's LCA must certify a wage at or above the DOL prevailing wage for a sales management role in your specific metro area. VP-level roles typically fall at wage Level III or IV, which reflects experienced and fully competent workers. You can look up the applicable wage using the OFLC Wage Search by entering the SOC code for Sales Managers and your work location.
Can I transfer my H-1B to a new company for a VP of Sales role?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as the transfer petition is filed with USCIS, without waiting for approval, as long as you've been in valid H-1B status for at least 180 days. Your new employer files a fresh I-129 with a new LCA certified for the VP of Sales role at their organization.
Does a VP of Sales role count as a specialty occupation if my duties are broad?
USCIS evaluates specialty occupation based on whether the position normally requires a specific bachelor's degree, not just a degree in any field. Broad commercial leadership duties can weaken the petition unless the employer documents that the role requires specialized knowledge in areas like strategic account management, market analysis, or enterprise sales methodology tied to a defined discipline. A well-drafted support letter from the employer is essential.
