Align your credentials with specialty occupation standards
Your Chilean computer science or software engineering degree must map directly to the role's technical requirements. USCIS reviews the degree-to-job match closely, so a generic engineering degree supporting a highly specialized role may need supplemental documentation explaining the connection.
Use OFLC Wage Search before accepting an offer
Run your target job title and location through OFLC Wage Search before any salary negotiation. Your employer's Labor Condition Application must certify the offered wage meets the prevailing wage for your level, and a low offer can trigger DOL scrutiny or delay certification.
Search H-1B1 Chile sponsorship jobs on Migrate Mate
Filter by H-1B1 Chile visa on Migrate Mate to surface employers whose DOL filing history confirms they've sponsored this visa category before. That filing history tells you far more about a company's actual sponsorship capability than any recruiter's verbal assurance.
Flag your visa type explicitly in recruiter conversations
Many U.S. recruiters conflate H-1B1 visa Chile with standard H-1B visa. Clarify upfront that your visa requires no lottery, no USCIS petition, and processes at the consulate in Santiago or another qualifying post. This removes the most common employer objection before it stalls the process.
Confirm your employer's E-Verify enrollment before the offer stage
H-1B1 Chile employers are required to use E-Verify to confirm your employment authorization. If a company isn't enrolled, they must register before you can start. Raising this after an offer is accepted creates avoidable delays, so verify enrollment during the interview process.
Review your O*NET occupation profile for the LCA job zone
Senior Software Engineering falls under O*NET's highest job zone, which supports the specialty occupation classification. Reviewing your O*NET profile lets you match your application language to the official occupational definition DOL and consular officers reference when evaluating your case.
Frequently Asked Questions
Does Senior Software Engineering qualify as a specialty occupation for the H-1B1 Chile visa?
Yes. Senior Software Engineering requires at least a bachelor's degree in computer science, software engineering, or a directly related field, which satisfies USCIS's specialty occupation definition. The role's technical depth and degree requirement make it one of the more straightforward H-1B1 Chile classifications, with minimal risk of a specialty occupation challenge from a consular officer.
How does the H-1B1 Chile visa compare to H-1B for Senior Software Engineering roles?
For Chilean nationals, the H-1B1 Chile visa is more predictable than H-1B for this role. There's no lottery, no USCIS petition filing, and the 1,400-visa annual cap has not historically been exhausted. You apply directly at a U.S. consulate after your employer files a certified LCA with DOL. H-1B requires USCIS approval and, for cap-subject cases, lottery selection, which adds months of uncertainty H-1B1 Chile avoids entirely.
How do I find employers who have sponsored H-1B1 Chile visas for software engineering roles before?
Migrate Mate filters job listings by H-1B1 Chile visa category and surfaces employers with verified DOL filing history for this visa type. That filing history is the most reliable indicator that a company understands the process, has legal infrastructure in place, and won't back out when they realize it differs from standard H-1B.
What happens if my H-1B1 Chile visa expires while I'm still employed at the same company?
H-1B1 Chile is issued in one-year increments and must be renewed annually at a U.S. consulate. If your visa stamp expires while you're in valid H-1B1 status inside the U.S., you can continue working without interruption until your authorized stay ends. You only need a new visa stamp when you travel internationally and re-enter. Your employer files a new LCA with DOL to support each renewal.
Can I switch employers after starting a Senior Software Engineering role on H-1B1 Chile?
Yes, but the H-1B1 Chile visa is employer-specific, so your new employer must file a fresh LCA with DOL and obtain consular approval before you begin working for them. Unlike H-1B portability under AC21, H-1B1 Chile has no portability provision, meaning you cannot start with a new employer while a transfer is pending. Plan the transition timeline with both employers before giving notice.
