Translate your degree for U.S. employers
Chilean computer science and engineering degrees are generally recognized as specialty-occupation credentials, but get a formal equivalency evaluation before applying. U.S. hiring managers often can't assess foreign transcripts, and documentation gaps delay LCA filing.
Target employers with active LCA filing histories
Use Migrate Mate to filter Software Development Manager roles by employers who have previously filed Labor Condition Applications for this occupation code, so you're targeting companies that already understand H-1B1 Chile sponsorship mechanics.
Confirm the role meets specialty occupation standards
The H-1B1 Chile requires the position to qualify as a specialty occupation requiring a directly related bachelor's degree or higher. Cross-check the job description against the O*NET profile for Software Development Managers to verify the degree requirement is explicit, not implied.
Ask employers to file the LCA before your I-94 expires
The LCA must be DOL-certified before the consulate appointment. If you're already in the U.S. on another status, confirm your employer submits to DOL with enough lead time since LCA certification typically takes seven business days.
Verify the offered wage against DOL prevailing wage data
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your role and work location. Look up the applicable wage level yourself using the OFLC Wage Search before negotiating your offer, so you enter salary discussions with accurate data.
Clarify H-1B1 Chile renewal mechanics with your offer team
H-1B1 Chile status is granted in one-year increments and requires consular renewal, not a USCIS extension. Make sure your employer's HR or legal team understands this before signing, since companies accustomed only to H-1B visa sometimes build incorrect timelines into offer letters.
Frequently Asked Questions
Does a Software Development Manager role qualify as a specialty occupation for the H-1B1 Chile visa?
Yes. Software Development Manager positions require a bachelor's degree or higher in computer science, software engineering, or a closely related field, which meets the H-1B1 Chile specialty occupation standard. The job description must reflect that degree requirement explicitly. If the posting lists a degree as preferred rather than required, the employer may need to revise it before filing the Labor Condition Application with DOL.
How does the H-1B1 Chile visa compare to the H-1B for Software Development Manager roles?
Both visas cover specialty occupation roles like Software Development Manager, but the H-1B1 Chile has no lottery, an annual cap of 1,400 that rarely fills, and is processed at the U.S. consulate rather than through USCIS. The tradeoff is that H-1B1 Chile doesn't permit dual intent, meaning you can't use it as a direct path to a green card the way an H-1B petition can support an immigrant visa filing.
How do I find employers who will sponsor an H-1B1 Chile visa for a Software Development Manager position?
Use Migrate Mate to search Software Development Manager roles filtered by employers with verified Labor Condition Application filing history for this occupation. Companies that have filed LCAs for similar roles already understand the sponsorship process and are less likely to withdraw an offer after learning the visa mechanics. Avoid spending time on employers who have no prior sponsorship activity.
Can my employer switch me from H-1B1 Chile to H-1B status while I'm working as a Software Development Manager?
Yes, but it requires a full H-1B petition filed with USCIS, and you would be subject to the annual H-1B cap and lottery unless the employer is cap-exempt. Many employers pursue this route after a year or two because H-1B status supports immigrant intent and offers longer initial approval periods. Confirm your employer is willing to file before accepting an H-1B1 Chile-only offer if long-term U.S. residency is your goal.
What happens if my H-1B1 Chile status expires while my renewal is pending?
H-1B1 Chile is renewed at the U.S. consulate, not through USCIS, so there's no automatic cap-gap or status extension while a renewal is pending. You need to time your consulate appointment before your current I-94 admission period ends. If you're outside the U.S. at renewal, plan for current wait times at your consulate, since delays can affect your start date for the next employment year.
