Get Access To All JobsTips for Finding Visa Sponsorship as a Staff Software Engineer
Verify your degree field matches the role
Staff Software Engineer roles require a specialty occupation showing your degree directly relates to the position. A computer science, software engineering, or closely related technical degree satisfies this. A general business or unrelated STEM degree creates LCA complications your employer must address.
Target employers already filing LCAs
Search the OFLC Wage Search to identify companies that have certified LCAs for software engineering roles at the Staff level. These employers already understand the H-1B1 Chile process and won't need to be educated on consular filing requirements.
Use Migrate Mate to find verified sponsoring employers
Search Migrate Mate to filter Staff Software Engineer openings by employers with confirmed H-1B1 visa Chile visa filing history. This cuts the research time of manually cross-referencing DOL disclosure data against active job postings.
Confirm your title maps to SOC code 15-1252
Staff Software Engineer roles typically fall under SOC code 15-1252 in the O*NET classification system. Your LCA must reference the correct SOC code, so confirm your employer's job description aligns with this classification before the DOL filing begins.
Negotiate your start date around LCA certification
DOL certifies LCAs within seven business days, but consular appointment availability in Santiago varies. Build at least three to four weeks between your offer acceptance and your target start date so your employer isn't filing under pressure.
Prepare a nonimmigrant intent response before your interview
Unlike H-1B visa, the H-1B1 Chile visa doesn't allow dual intent. Consular officers will probe your plans after the visa period ends. Have a clear, honest answer about ties to Chile and your intended timeline before your Santiago appointment.
Frequently Asked Questions
Does a Staff Software Engineer role qualify as a specialty occupation for H-1B1 Chile?
Yes. Staff Software Engineer is a specialty occupation under the H-1B1 Chile visa because the role normally requires at least a bachelor's degree in computer science, software engineering, or a directly related field. Your employer confirms this in the Labor Condition Application filed with DOL. Roles where any degree is accepted regardless of field would not qualify.
How does H-1B1 Chile compare to H-1B for Staff Software Engineer positions?
H-1B1 Chile skips the lottery entirely, has no USCIS petition requirement, and is processed directly at the consulate in Santiago. H-1B requires USCIS approval before you can enter the U.S. and is subject to an annual lottery. For a Staff Software Engineer with a confirmed offer, H-1B1 Chile is typically faster and more predictable, though it doesn't allow dual intent the way H-1B does.
Where can I find Staff Software Engineer jobs that offer H-1B1 Chile visa sponsorship?
Migrate Mate lets you search Staff Software Engineer openings filtered by employers with documented H-1B1 Chile visa filing history, so you're not guessing which companies will sponsor. The platform surfaces DOL Labor Condition Application data so you can see which employers have filed for this role type before applying.
Can my H-1B1 Chile status cover a promotion from Software Engineer to Staff Software Engineer?
A material change in job duties or title requires your employer to file a new LCA with DOL before the promotion takes effect. If the Staff-level role involves substantially different responsibilities or a different SOC code, treat it as a new H-1B1 Chile filing, not just an internal HR update. Check with your employer's immigration contact before the change is finalized.
How long can I stay in the U.S. on H-1B1 Chile as a Staff Software Engineer?
Each H-1B1 Chile admission is valid for up to one year and can be renewed in one-year increments indefinitely, as long as you maintain a qualifying job offer and your employer recertifies the LCA with DOL. There's no maximum cap on renewals, but each extension requires an updated Labor Condition Application showing the prevailing wage for your role and location.
