Verify your degree meets specialty occupation
H-1B1 visa requires your role to qualify as a specialty occupation, meaning a directly related bachelor's degree. A marketing, communications, or business degree typically satisfies this, but a general arts degree with no marketing coursework may draw scrutiny from the consular officer.
Target employers with active LCA filing history
Search Migrate Mate to identify employers who have filed Labor Condition Applications for marketing roles. LCA history signals an employer already understands the H-1B1 sponsorship process, which means fewer delays and less internal education on your end.
Request the LCA before negotiating your offer
Your employer must file and receive DOL certification of the LCA before you can apply at the consulate. Ask your hiring manager to confirm LCA filing timelines during the offer stage so you're not waiting on paperwork after you've already accepted.
Check prevailing wage before your salary conversation
Use the OFLC Wage Search to look up the prevailing wage for marketing associate roles in your target city. Your offered salary must meet or exceed this threshold for DOL to certify the LCA, so knowing the floor before negotiating protects both you and your employer.
Bring a DS-160 and LCA to your consulate appointment
Unlike H-1B visa, H-1B1 is processed entirely at the U.S. consulate in Singapore, with no USCIS petition involved. Prepare your DS-160, certified LCA, offer letter, degree transcripts, and passport well in advance of your appointment date to avoid adjournment requests.
Clarify employer E-Verify status early in your search
Some marketing roles, especially at startups or smaller agencies, are at employers not enrolled in E-Verify. While E-Verify enrollment isn't always required for H-1B1 itself, confirming it early prevents complications if the employer later seeks federal contracts or STEM-eligible roles.
Frequently Asked Questions
Does a Marketing Associate role qualify for the H-1B1 Singapore visa?
Yes, provided the position genuinely requires a bachelor's degree in a directly related field such as marketing, communications, or business. A role where any bachelor's degree is acceptable regardless of field will not meet the specialty occupation standard. Your employer's job description and internal requirements are what USCIS and the consular officer evaluate.
How does the H-1B1 Singapore visa differ from H-1B for marketing professionals?
The H-1B1 has no lottery and a rarely-filled annual cap of 5,400 visas, so a qualified Singaporean marketing professional can apply at the consulate without waiting for a random selection outcome. H-1B requires a USCIS petition, subjects applicants to the annual lottery, and is capped at 85,000. The trade-off is that H-1B1 does not allow dual intent, meaning you cannot hold an approved immigrant visa petition simultaneously.
How do I find employers who actively sponsor H-1B1 visas for marketing roles?
Search Migrate Mate to filter for employers with documented LCA filing history in marketing occupations. Many companies that sponsor H-1B visas will also sponsor H-1B1, and LCA data from DOL disclosure records is the most reliable public signal of an employer's actual sponsorship track record, rather than what a job posting says.
Can my employer file the LCA for a Marketing Associate role without an immigration lawyer?
Yes. The LCA is filed through the DOL's FLAG system and does not require legal representation, though many employers use counsel for accuracy. The employer must post notice of the LCA at the worksite for ten consecutive business days and certify the wage meets the prevailing wage determined via the OFLC Wage Search for your specific metro area.
What happens to my H-1B1 status if my marketing job is eliminated or I resign?
H-1B1 status is employer-specific and tied to the certified LCA. If your employment ends, you have a short grace period of up to 60 days to find a new sponsoring employer, change status, or depart the U.S. There is no automatic portability between employers, so your new employer must file a fresh LCA and you must return to the consulate to obtain a new H-1B1 stamp.
