Frame your degree field precisely
H-1B1 visa requires a specialty occupation tied to a specific academic discipline. A marketing degree supports a Marketing Lead role directly, but an unrelated degree needs documented coursework or credentials showing marketing specialization before your consulate interview.
Search verified H-1B1 filers on Migrate Mate
Filter for employers who have filed H-1B1 Labor Condition Applications for marketing roles. Migrate Mate surfaces this DOL filing history so you target companies already familiar with the H-1B1 process, not ones encountering it for the first time.
Target mid-size tech and SaaS employers
Companies scaling a U.S. marketing function often need a dedicated Marketing Lead without the overhead of a large sponsorship program. These employers frequently file Labor Condition Applications directly without outside counsel, making the H-1B1 process faster to initiate.
Confirm your employer will certify the LCA early
Your employer files the Labor Condition Application with DOL before your consulate appointment. Ask during negotiations whether they've certified an LCA before and who internally owns the filing, since delays here push back your entire timeline.
Prepare a role-specific specialty occupation letter
Consular officers can probe whether a Marketing Lead role genuinely requires a specialized degree. Request a detailed support letter from your employer that maps the role's strategic and analytical responsibilities to your specific academic discipline, not a generic job description.
Use the OFLC Wage Search before accepting an offer
Your employer must pay the prevailing wage for your occupation and location under DOL rules. Run the OFLC Wage Search yourself using your job title and metro area to verify the offer meets the threshold before your LCA is filed.
Frequently Asked Questions
Does a Marketing Lead role qualify as a specialty occupation for H-1B1?
Yes, provided the role requires a bachelor's degree or higher in a directly related field such as marketing, communications, or business. A generic marketing coordinator role may face scrutiny, but a Marketing Lead position involving strategy, analytics, and campaign oversight typically satisfies the specialty occupation definition. Your employer's support letter should document the degree requirement explicitly.
How does H-1B1 Singapore compare to H-1B for Marketing Lead roles?
H-1B1 skips the lottery entirely and is processed at the U.S. consulate in Singapore rather than through USCIS, which removes months of petition processing time. The tradeoff is that H-1B1 doesn't allow dual intent, meaning you can't simultaneously pursue a green card while on H-1B1 status. For Singaporean professionals focused on working in the U.S. near-term, H-1B1 is a faster and more predictable path.
Which employers actively sponsor H-1B1 visas for marketing roles?
Migrate Mate lets you filter job listings by employers with confirmed H-1B1 Labor Condition Application filings, so you can focus on companies that have already navigated the process for marketing positions. Technology companies, SaaS platforms, and U.S. subsidiaries of multinational firms tend to file H-1B1 LCAs for senior marketing roles most consistently.
Can I switch employers after entering the U.S. on H-1B1?
Yes, but the new employer must file a fresh Labor Condition Application with DOL and you'll need to attend a new consulate interview or apply for a change of status, depending on your situation. Unlike H-1B visa portability under AC21, H-1B1 doesn't allow you to start working for a new employer while the new application is pending, so plan your transition carefully.
What happens if my H-1B1 application is refused at the consulate?
A refusal doesn't permanently bar you from reapplying. Officers most commonly refuse H-1B1 applications over specialty occupation documentation gaps or questions about nonimmigrant intent. You can reapply after addressing the specific reason cited in your refusal. Strengthening your employer's support letter and ensuring your degree clearly aligns with your Marketing Lead responsibilities are the most direct fixes.
