Lead with your technical stack
Employers and USCIS both want specificity. List the exact tools you've worked with, ETL platforms, SQL variants, cloud migration frameworks. A vague 'data experience' claim won't support a specialty occupation petition the way concrete technical credentials will.
Confirm your degree field aligns with the role
Computer Science, Information Systems, and Data Engineering degrees map cleanly to this title. If your degree is in a tangential field, document how your coursework directly supports data migration work, USCIS will scrutinize the connection during petition review.
Target employers with active H-1B filing histories
Consulting firms and enterprise technology companies file H-1B petitions for this role regularly. Focusing your search on sponsors with established immigration programs reduces your risk of an employer backing out mid-process due to unfamiliarity with sponsorship.
Quantify migration scope in your resume and interview
Scale matters for specialty occupation arguments. Describe the volume of data migrated, number of systems integrated, and business impact of each project. These details strengthen both your candidacy and the legal narrative your employer's attorney will build.
Understand the LCA process your employer must complete
Before USCIS reviews your H-1B petition, your employer files a Labor Condition Application with the Department of Labor. This certifies your role meets prevailing wage requirements. Knowing this step exists helps you set realistic timelines with your sponsoring employer.
Clarify sponsorship expectations before accepting an offer
Some employers sponsor H-1B transfers for current visa holders but won't file new cap-subject petitions. Confirm exactly what your employer will cover, petition filing, legal fees, premium processing, before you sign. Ambiguity here creates serious problems later.
Frequently Asked Questions
Does data migration consulting qualify as an H-1B specialty occupation?
Yes. Data Migration Consultant roles typically require at least a bachelor's degree in Computer Science, Information Systems, or a related technical field, which satisfies the H-1B visa specialty occupation definition. USCIS looks for roles where a specific degree is a minimum requirement, not just preferred, so job descriptions should reflect that language clearly.
Can I get H-1B sponsorship as a data migration consultant at a staffing or consulting firm?
Yes, but with added scrutiny. USCIS applies stricter review to consulting firm petitions because consultants often work at third-party client sites rather than the petitioning employer's location. Your employer will need to document the specific client engagement, work location, and that they maintain employer-employee control throughout the placement. This is manageable but requires a thorough petition.
What degree do I need for a data migration consultant role to qualify for visa sponsorship?
A bachelor's degree in Computer Science, Information Systems, Data Engineering, or a closely related technical discipline is the standard baseline. Degrees in adjacent fields like Mathematics or Electrical Engineering can work if your coursework included database systems or programming. USCIS may also accept three years of relevant work experience as a substitute for each year of formal education you're missing.
How do I find data migration consultant jobs that offer visa sponsorship?
Migrate Mate is built specifically for international candidates on work visas, every listing is screened for sponsorship willingness, so you're not guessing which employers will file. Filter by visa type to find roles compatible with your current status, whether that's H-1B, OPT, or another category.
Does project-based or contract data migration work affect my visa status or sponsorship eligibility?
It can. H-1B status is tied to your sponsoring employer, so switching between projects at different client sites is generally fine, but changing employers requires a new H-1B transfer petition. Contract roles through staffing agencies introduce additional USCIS scrutiny around employer-employee relationships. If you're on OPT, ensure each engagement falls within your authorized field before accepting short-term project work.
What is the prevailing wage requirement for sponsored Data Migration Consultant jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
