Verify your degree meets specialty occupation
U.S. internships must require a bachelor's degree in a specific field to qualify for E-3 visa status. A construction management or civil engineering degree ties directly to the role. A general business degree usually won't clear the specialty occupation threshold.
Target firms with active DOL filing history
Search the DOL's foreign labor certification disclosure data for construction companies that have filed Labor Condition Applications before. Firms with prior LCA experience understand the E-3 process and won't treat sponsorship as a dealbreaker during hiring.
Find E-3 construction roles on Migrate Mate
Migrate Mate filters construction internship listings by E-3 sponsorship availability, so you're not cold-applying to roles where the employer has never heard of the visa. Use Migrate Mate's E-3 filing service to handle your LCA and visa paperwork once you receive an offer.
Clarify internship duration before your interview
E-3 status is granted in two-year increments, but many construction internships last three to twelve months. Confirm whether the employer can convert the role to full-time or extend your placement, since your E-3 must reflect the actual employment period on the LCA.
Confirm the employer files LCA before your consulate date
Your U.S. consulate interview requires a certified LCA in hand. The employer files with DOL first, which typically takes seven business days. Don't book your appointment at the Sydney, Melbourne, or Perth consulate until the certified LCA is returned and your DS-160 is complete.
Address your 3-year degree equivalency upfront
Australian bachelor's degrees are three years, not four. Some U.S. construction employers question whether this meets the bachelor's degree requirement. Request a credential evaluation from a USCIS-recognized evaluation service before submitting your application to preempt any objections.
E-3 Visa Construction Intern: Frequently Asked Questions
How do I find Construction Intern jobs that offer E-3 visa sponsorship?
Most construction internship postings don't advertise E-3 sponsorship directly, which makes standard job board searches unreliable. Migrate Mate filters roles by E-3 sponsorship availability, so you can focus on employers already set up to file an LCA. Reaching out to firms with prior DOL filing history also improves your odds of a straightforward sponsorship conversation.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does a Construction Intern role actually qualify as a specialty occupation for the E-3?
It can, but the job description matters. The role must require a bachelor's degree in a specific field like civil engineering or construction management, not just any degree. Internships that are primarily physical labor or don't require theoretical knowledge from a relevant degree won't qualify. Ask the employer to confirm the role is listed as requiring a specific degree before accepting the offer.
How does the E-3 compare to the H-1B for Construction Intern roles?
The E-3 is available to Australian nationals only, but it has no annual lottery and no cap to worry about. H-1B visa requires entering a lottery with roughly a 25% selection rate before any filing can proceed. For a construction internship, the E-3 means you can accept an offer and move forward immediately, while H-1B candidates may wait a year or more before starting.
Can I switch construction employers while on an E-3 internship?
Yes, but the process restarts with the new employer. Your E-3 status is tied to the specific employer and LCA on file. If you move to a different construction firm, they need to file a new LCA with DOL and you'll need a new E-3 visa stamp if you travel internationally. You can begin working for the new employer once the new LCA is certified and your updated visa is approved.
