Verify your degree meets specialty occupation standards
Your Chilean bachelor's degree must align directly with the role's field, not just the industry. Pull the O*NET profile for your target job title to confirm the required education level matches your credentials before applying.
Target employers with active LCA filing history
Use Migrate Mate to filter employers by verified DOL Labor Condition Application filings for your occupation code. This cuts out the guesswork of cold-applying to companies that have never sponsored a specialty occupation visa.
Build your role-to-degree connection into every application
USCIS requires a direct relationship between your degree field and the specific duties of the role. At entry level, where job descriptions are broad, spell out that connection explicitly in your resume and cover letter before the employer even contacts an attorney.
Time your job search around annual renewal cycles
H-1B1 Chile status is granted in one-year increments. Employers who've sponsored before know renewals are routine, but first-time sponsors sometimes misread the one-year term as a risk. Focus your outreach on employers with prior H-1B visa or H-1B1 filing experience.
Use the OFLC Wage Search to set realistic salary expectations
Your employer must pay the prevailing wage for your occupation and location under DOL rules. Look up your role's wage level in the OFLC Wage Search before negotiating so you understand the floor the employer is legally required to meet.
Frequently Asked Questions
What types of entry level jobs qualify for H-1B1 Chile sponsorship?
Roles that qualify are specialty occupations requiring at least a bachelor's degree in a directly related field. At entry level, this typically includes positions in software engineering, financial analysis, accounting, civil engineering, and architecture. The degree-to-role match is evaluated individually by USCIS, so a generalist business degree won't support a software developer application even at the entry level.
How do I find employers who are open to sponsoring H-1B1 Chile visas?
Search on Migrate Mate, which filters employers by verified DOL Labor Condition Application filing history for specific occupation codes. This shows you which companies have actually filed for specialty occupation workers in your field, rather than relying on vague claims in job postings. Employers with prior LCA filings for your role type already have the compliance process in place.
Is the H-1B1 Chile subject to an annual cap or lottery?
The H-1B1 Chile has a separate annual allocation of 1,400 visas for Chilean nationals and is not subject to the H-1B lottery. The allocation has never been exhausted in any fiscal year, which means qualified applicants with a valid job offer can apply at any time without waiting for a lottery selection. USCIS processes H-1B1 Chile applications year-round.
Can I start working immediately after my employer files the H-1B1 petition?
No. Unlike cap-subject H-1B petitions that sometimes carry cap-gap protections, H-1B1 Chile requires the petition to be approved before you begin work. If you're transitioning from F-1 OPT or another status, your start date must align with your approval notice, not your filing receipt. Build buffer time into your offer negotiation to account for USCIS processing.
What should I check before accepting an entry level offer from a company offering H-1B1 sponsorship?
Confirm the employer has filed LCAs before for your occupation code, that the role's duties match your degree field specifically, and that the offered pay meets the DOL prevailing wage for your location. You can cross-reference wage requirements using the OFLC Wage Search. Employers unfamiliar with H-1B1 Chile sometimes underestimate the documentation required to establish specialty occupation status for entry level roles.
