Document your specialized AI credentials early
Gather transcripts, published papers, patents, and employer letters that tie your work directly to generative AI systems. PERM requires proof your role demands a specific degree, so vague credentials slow the labor certification.
Target employers with active PERM filing history
Search DOL OFLC disclosure data for companies that have filed PERM applications for machine learning or AI engineer roles. Employers who've navigated PERM before move faster and make fewer procedural errors on your case.
Verify your role qualifies under the right EB category
Use O*NET to confirm your generative AI responsibilities map to a recognized specialty occupation. EB-2 requires an advanced degree or equivalent; EB-3 covers bachelor's-level positions, and the category affects your priority date and wait time.
Ask employers about concurrent I-140 and I-485 filing
If a visa number is current for your country when your I-140 is approved, you can file I-485 adjustment of status concurrently. This shortens the gap between PERM approval and your green card, so raise it before signing an offer.
Search for green card sponsoring roles on Migrate Mate
Filter by EB-2 or EB-3 sponsorship to find Generative AI Engineer openings from employers already set up for PERM. Migrate Mate surfaces roles where sponsorship is confirmed, so you're not guessing from a generic job listing.
Confirm E-Verify enrollment before accepting an offer
Employers sponsoring you for a green card must be in good standing with employment eligibility verification. If a company isn't E-Verify enrolled, that's a flag worth resolving before PERM is filed, not after.
Green Card Generative AI Engineer: Frequently Asked Questions
Does a Generative AI Engineer role qualify for EB-2 green card sponsorship?
Yes, if the position requires a master's degree or higher in computer science, artificial intelligence, or a closely related field, it typically qualifies for EB-2. Employers must document through PERM that the advanced degree is a legitimate business requirement for the role, not just a preference. Roles that accept a bachelor's degree with experience generally fall under EB-3 instead.
How does green card sponsorship differ from H-1B sponsorship for this role?
H-1B visa is a temporary work visa with an annual lottery and a six-year cap, while EB-2 and EB-3 green card sponsorship is permanent and has no lottery. The PERM process adds time upfront, typically 12 to 24 months before the I-140 is even filed, but the outcome is lawful permanent residency rather than a status you have to renew. For many countries, EB-3 has no meaningful wait at the current priority date, making it faster to a green card than repeated H-1B extensions for some applicants.
What does the PERM labor certification process look like for a Generative AI Engineer?
Your employer files an ETA 9089 with DOL after completing a mandatory recruitment period to show no qualified U.S. workers were available for the role. For a Generative AI Engineer position, the job description must precisely define the AI-specific requirements, including the degree field and any specialized skills like large language model training or fine-tuning, so the role isn't deemed too broadly defined during an audit.
How do I find employers actively willing to sponsor a green card for generative AI roles?
Use Migrate Mate to search specifically for EB-2 and EB-3 sponsored Generative AI Engineer positions. Many job listings don't advertise PERM sponsorship openly, so filtering by confirmed sponsorship status saves significant time. You can also cross-reference DOL OFLC disclosure data to verify whether a company has filed PERM applications for similar AI roles in the past.
Can I switch employers after my I-140 is approved without losing my place in line?
Yes, under AC21 portability rules, you can change employers once your I-140 has been approved and your I-485 has been pending for at least 180 days, as long as the new role is in the same or a similar occupational classification. For a Generative AI Engineer, that means moving to another AI or software engineering role generally qualifies, but switching to an unrelated field could void the benefit.
