Technical Sales Consultant roles qualify for EB-2 or EB-3 green card sponsorship when the position requires a bachelor's degree in a technical field and involves consultative selling of specialized products or services. Employers file a PERM labor certification with DOL before sponsoring you for permanent residency, not just a temporary work visa.

Document your technical degree alignment
PERM requires the job description to match your credentials exactly. Make sure your degree field and job duties align on paper before applying, since employers can't retroactively adjust the labor certification to fit a credential mismatch.
Target employers with active PERM filings
Use the OFLC Wage Search to look up companies that have filed PERM applications for sales or technical consultant roles. Past filings signal that a company already has an immigration infrastructure and won't need to be educated on the process from scratch.
Clarify EB-2 versus EB-3 track early
If your Technical Sales Consultant role requires only a bachelor's degree, you'll typically land in EB-3. Roles requiring an advanced degree or specialized expertise can qualify for EB-2, which may offer a shorter wait time depending on your country of birth.
Ask employers about PERM recruitment timing
PERM filings can't start until your employer completes a mandatory recruitment period, often 30 to 60 days. Ask during the offer stage whether they've started this process, since the full green card timeline won't begin until PERM is filed with DOL.
Search sponsoring employers on Migrate Mate
Filter by green card sponsorship history to find Technical Sales Consultant openings at companies with a documented track record of filing PERM applications. Migrate Mate surfaces that employer data so you're not guessing about sponsorship willingness from a job posting.
Cross-check your role against O*NET
USCIS and DOL evaluators reference O*NET occupation profiles when assessing whether a Technical Sales Consultant role qualifies as a specialty occupation. Confirming your duties align with the standard profile strengthens both PERM and I-140 adjudication.
Green Card Technical Sales Consultant: Frequently Asked Questions
Does a Technical Sales Consultant role qualify for EB-2 or EB-3 sponsorship?
Most Technical Sales Consultant positions qualify under EB-3 as skilled worker or professional roles requiring a bachelor's degree. EB-2 applies when the position genuinely requires an advanced degree or when you qualify for a National Interest Waiver, which is rare in sales-oriented roles. Your employer's attorney will determine the appropriate category based on the job requirements and your credentials.
How does green card sponsorship differ from H-1B for this role?
Green card sponsorship through PERM and I-140 leads to permanent residency, not a temporary status that expires. There's no annual lottery for EB-3, and once your I-140 is approved, your place in line is secured even if you change employers after 180 days. H-1B visa is capped at 85,000 per year and subject to a lottery, while EB-3 PERM filings face no cap at the petition stage.
What does the PERM process look like for a Technical Sales Consultant?
Your employer files ETA Form 9089 with DOL after completing a mandatory recruitment period to show no qualified U.S. workers were available for the role. For a Technical Sales Consultant position, the job description must specify minimum education and technical requirements. DOL review typically takes several months, and approval triggers the I-140 immigrant petition filing with USCIS.
Where can I find Technical Sales Consultant jobs that offer green card sponsorship?
Migrate Mate is built specifically for foreign professionals seeking employment-based green card sponsorship. You can filter for Technical Sales Consultant openings at employers with a documented history of PERM filings, so you're targeting companies that have already sponsored workers rather than those that might be open to it in theory.
Can I negotiate who pays green card filing fees in a Technical Sales Consultant offer?
Attorney fees and most PERM-related costs are typically employer-paid, and DOL prohibits employers from passing certain costs to the employee. Government filing fees for I-140 are the employer's responsibility. Negotiating reimbursement for personal legal counsel during the process is reasonable and common in technical roles where employers compete for skilled candidates.
