Verify your degree maps to ABM
USCIS requires your degree field to directly relate to your role. A marketing, communications, or business degree typically qualifies for ABM positions. A computer science degree alone may trigger an RFE unless your job description emphasizes technical marketing systems.
Check LCA filings for ABM roles
Use the OFLC Wage Search to look up Labor Condition Applications filed under SOC codes for marketing specialists and market research analysts. Employers who have filed LCAs for these codes have already cleared the DOL wage certification step for similar roles.
Target B2B tech companies with immigration programs
Enterprise SaaS and cloud infrastructure companies run structured ABM functions and file H-1B petitions at scale. Prioritize companies with dedicated immigration counsel on staff rather than those that outsource sponsorship decisions to HR generalists.
Search Migrate Mate for verified H-1B sponsors
Filter ABM roles on Migrate Mate by employers with active H-1B filing history. This cuts time spent on companies that list sponsorship as optional but have never filed a petition for a marketing role.
Negotiate sponsorship terms before accepting an offer
Confirm whether the employer covers the I-129 filing fee and premium processing before signing. ABM roles often come with performance bonuses that affect your prevailing wage compliance, so get your base salary structure in writing early.
Prepare for specialty occupation questions in your petition
USCIS scrutinizes marketing roles more than engineering roles. Have your employer document why your ABM position requires a specific degree, not just a general business background. Job postings, org charts, and your actual project scope all strengthen the petition.
H-1B Visa Account Based Marketing: Frequently Asked Questions
Does an Account Based Marketing role qualify as a specialty occupation for H-1B?
Yes, ABM roles can qualify when the employer demonstrates the position requires a bachelor's degree in a specific field such as marketing, business, or communications. USCIS applies heightened scrutiny to marketing titles, so the job description needs to show that the degree is a minimum requirement, not just preferred. Roles tied to enterprise pipeline strategy and revenue attribution tend to hold up better than generalist marketing coordinator titles.
Which industries sponsor H-1B visas most often for ABM professionals?
Enterprise SaaS, cybersecurity, cloud infrastructure, and B2B fintech companies sponsor the largest share of H-1B petitions for ABM roles. These sectors run structured ABM programs with dedicated headcount and established immigration processes. Companies selling complex, high-value products to enterprise accounts are more likely to view ABM as a specialized, degree-requiring function worth sponsoring. Use Migrate Mate to browse verified sponsors in these categories.
How does the H-1B cap lottery affect my ABM job search timeline?
USCIS opens H-1B registration each March for the following fiscal year starting October 1. If you're on OPT or STEM OPT, your employment authorization needs to bridge the gap until your H-1B activates. Plan your ABM job search to have an offer and a registered petition before your current status expires. Cap-exempt employers such as universities and nonprofits can file outside the lottery window.
What prevailing wage level applies to Account Based Marketing positions?
Most ABM roles fall under SOC codes for marketing specialists or market research analysts. Your employer's LCA must certify a wage at or above the prevailing wage for that SOC code in the work location, as determined by DOL. Senior ABM roles with strategy or management scope typically land at wage Level III or IV. You can check applicable wage levels using the OFLC Wage Search before evaluating offers.
Can I switch ABM jobs after my H-1B is approved?
Yes, under H-1B portability rules you can change employers once a new employer files an H-1B transfer petition and you've maintained valid status. The new role must still qualify as a specialty occupation. If you move from a hands-on ABM execution role to a broader marketing generalist position, your new employer may need to support the specialty occupation argument from scratch.
