Verify your role meets specialty occupation
Advertising spans creative, strategy, media planning, and analytics. Pull your job's O*NET profile to confirm it requires a specific bachelor's degree field, not just any degree. A generalist title like 'marketing coordinator' is harder to defend than 'media strategist' or 'paid search analyst.'
Check employer LCA filing history first
Before applying, search DOL's Office of Foreign Labor Certification (OFLC) disclosure data to see which agencies and brands have filed Labor Condition Applications for advertising roles. Recent LCA activity signals an employer already has an immigration process in place, which shortens your path to a filed petition.
Use Migrate Mate to filter H-1B sponsors
Search advertising jobs on Migrate Mate to surface employers with verified H-1B sponsorship history. Filtering by employers who have actively filed for advertising and marketing roles cuts out the guesswork of cold-applying to companies with no sponsorship infrastructure.
Time your offer negotiation around lottery deadlines
H-1B registration opens in March for an October 1 start. If you're negotiating an offer in the fall, confirm whether the employer will sponsor you for the following fiscal year's cap. Some agencies default to OPT cap-gap extensions to bridge the gap while your petition is pending.
Clarify prevailing wage level during the offer
Your employer must file a Labor Condition Application certifying your wage meets DOL's prevailing wage for your role and location. Use the OFLC Wage Search to look up the Level I through Level IV wage range for your specific advertising occupation before you accept an offer.
Document degree-to-role alignment for the petition
USCIS scrutinizes advertising petitions because the field draws from multiple degree backgrounds. Gather transcripts, course descriptions, and any specialized coursework in brand strategy, digital media, or consumer behavior to build a direct connection between your degree and the specific duties in your job description.
H-1B Visa Advertising: Frequently Asked Questions
Do advertising jobs qualify for H-1B sponsorship?
Advertising roles qualify when the position requires at least a bachelor's degree in a specific field directly related to the job duties, meeting the USCIS specialty occupation standard. Titles like media planner, brand strategist, digital advertising analyst, and creative director typically qualify. Generalist marketing assistant roles with no specific degree requirement are harder to approve and attract closer USCIS scrutiny.
Which employers in advertising sponsor H-1B visas?
Large agency holding companies, major media networks, and brand-side marketing departments at consumer goods and technology companies are the most consistent H-1B sponsors in advertising. Smaller independent agencies sponsor less frequently, often because they lack dedicated immigration counsel. Migrate Mate lets you filter advertising roles by employers with confirmed H-1B filing history so you're targeting companies that already have a sponsorship process.
What happens to my H-1B if my agency loses a major client and downsizes?
If your employer terminates your position, you have a 60-day grace period to find a new sponsor, change to another visa status, or leave the country. Your new employer must file an H-1B transfer petition, and you can begin working as soon as the transfer petition is filed with USCIS, not just approved. Document your employment end date carefully since the 60 days runs from that date.
Can I switch from a boutique agency to an in-house brand team on H-1B?
Yes, H-1B portability allows you to transfer your petition to a new employer as long as the new job is in the same or a similar specialty occupation and your original petition was approved and you've been maintaining valid status. Your new employer files an H-1B transfer petition with USCIS, and you can start in the new role once the petition is received, not once it's adjudicated.
Does my advertising degree from outside the U.S. count for H-1B purposes?
Foreign degrees are accepted for H-1B petitions if they're equivalent to a U.S. bachelor's degree in the relevant field. Your employer typically commissions a credential evaluation from a recognized evaluation service, which USCIS reviews as part of the petition. A three-year degree from certain countries may require additional coursework or work experience to reach equivalency, so get an evaluation done before the petition is filed.
