Verify your role meets specialty occupation
Pull the Agency Owner occupation profile from O*NET and confirm your job duties require a specific bachelor's degree, not just any degree. USCIS denies petitions where the role accepts unrelated fields interchangeably.
Research the prevailing wage before negotiating
Run your job title, work location, and experience level through the OFLC Wage Search before accepting any offer. Your employer's LCA must certify a wage at or above the applicable prevailing wage level, and a low offer can create filing problems.
Target employers with established HR infrastructure
Agencies with dedicated HR or legal teams are far more likely to navigate H-1B paperwork correctly. Use Migrate Mate to filter for employers who have active H-1B filing history in management and business operations roles.
Confirm E-Verify enrollment before signing
Ask your prospective employer whether they're enrolled in E-Verify before the offer stage. Federal contractors and many state-regulated businesses are required to use it, and unenrolled employers face delays re-enrolling mid-petition.
Time your job search around the H-1B cap
H-1B cap registrations open in March for an October 1 start date. If you're changing employers mid-status, cap-exempt hospital or university sponsors can file outside that window. Factor in the 60-day grace period if your current status ends before October.
Document ownership interests carefully for USCIS
If the Agency Owner role involves any equity stake or profit-sharing, your petition must show a clear employer-employee relationship. USCIS scrutinizes ownership arrangements closely, and your attorney should address this explicitly in the support letter.

Find Agency Owner JobsAgency Owner H-1B Visa: Frequently Asked Questions
Does an Agency Owner role qualify as a specialty occupation for H-1B purposes?
It depends on how the role is defined and what degree is required. If the Agency Owner position requires a bachelor's degree specifically in business, marketing, or a related field, it can qualify. USCIS will reject the petition if the employer's job description accepts any bachelor's degree regardless of field, so the degree-to-job connection must be explicit in the offer letter and LCA.
Can a small or independent agency sponsor an H-1B for an Agency Owner?
Yes, company size doesn't disqualify an employer from sponsoring H-1B workers. Small agencies must still file a Labor Condition Application with DOL, pay the prevailing wage, and demonstrate a legitimate employer-employee relationship. The main risk at smaller firms is the ability-to-pay requirement: USCIS will review financials to confirm the employer can sustain the offered salary throughout the petition period.
How do I find agencies that are willing to sponsor H-1B visas for owner-level roles?
Search Migrate Mate to find employers with verified H-1B filing history in business operations and management roles. Agencies that have previously sponsored H-1B workers are far more likely to have the legal infrastructure and willingness to sponsor again. Cold outreach to agencies without that history tends to stall because they underestimate the filing complexity.
What happens to my H-1B status if the agency I own or co-own is dissolved?
If your sponsoring employer ceases operations, your H-1B status is no longer valid and your 60-day grace period begins. You can use that window to find a new employer willing to file a transfer petition. USCIS must receive the new petition within that grace period for your work authorization to continue without interruption. Document the dissolution date carefully for any future status questions.
Does the H-1B prevailing wage requirement apply differently for Agency Owner positions?
No, the prevailing wage requirement applies the same way regardless of seniority. DOL sets wage levels by occupation code, experience level, and work location. Your employer must certify on the LCA that your salary meets at least the Level I through Level IV threshold for your specific role and geography. You can verify the applicable wage using the OFLC Wage Search before the offer is finalized.
